Hi,

I had filed asylum case in UK in 1999 that was rejected and I deported back to my country India, can I apply asylum in Canada now

You cannot apply from India.

Your options are to get a TRV, travel to Canada and claim asylum once here.

Alternatively, you can move out of India to another country and be officially recognized as a refugee once there by UNHCR. UNHCR will then pick a country where you will be resettled.

Thanks for your very prompt reply, let me specify my query, I had applied asylum in UK in 1999 on different grounds, that was rejected I was deported to India, now I am in USA on valid visit visa, want to come to Canada and apply asylum on geniune ground, can there be any issues

Yes, there can be issues. You need a visa to enter Canada. You may not receive one. Asylum is long, complicated, and can be expensive if you do not have obviously valid grounds. You can expect scrutiny as you have had a rejected asylum claim and a deportation.

That you have a valid visit visa to the USA will help you get into Canada, may not help with an asylum claim.

If you don't mind sharing, what are your grounds for asylum?

If you haven't tried relocating to other regions of India you are likely to be refused. Getting asylum from India is very difficult.

just want to say you will not have it easy at all as i do not do immigration for a living and this sh=sounds like a fail to me. these are just a few things i wanted to ask you if i was the one making the decision on your claim

1. how long did you stay in india for after deportation ?
2. why havent you claim asylum in USA
3. How many time have you been to india and for how long since failed claim
4. why didnt you come to canada first instead of us.
5. why did your claim get rejected
6. india is a hell of a large country did you relocate?
7. do you have proof with time stamps.
8.do you have money to support your self cause bro/sis the process is hella long and i hear the government is now only covering like half the fees.
9. any articles or news that can say this is happening in my country and thats why am scared.
10. any one that can write supporting letters for you to say yes he/she has been ETC and is ETC.

and the list goes on.

even if you have all that the fact that you lied the first time wont actually help you as the decision makers are not stupid smart people they will say OKAY 1999 failed he/she did some research for 20 years and now he is coming back, he sent some text messages got some pictures and got his story together and now the story has chanaged and this is supposedly genie that is even funny-to me lol
