Hello,

Once a positive LMO is received, are you allowed to go to any border crossing to apply for the work permit? Or is it specific border crossings such as Buffalo?

My spouse is in Canada on a work permit and a temporary resident visa (she's from Indonesia) which expires in 2013. She was laid off and found an employer who has sent out an LMO. If the LMO comes back positive, are there any issues with her going to the border to apply for the new work permit?

Your wife doesn't qualify to apply at the border. In order to qualify, she would have to be visa exempt.

Since going to the border is not an option, your wife should use the "apply from inside of Canada" option:

so even if she has a temporary resident visa, she's not able to go to the border to apply for the work permit? because on this thread it seems like people from NON visa exempt countries have been able to do so....

Infact there is a thread below of a member who got a new WP at the border with a valid work permit but an expired TRV:

I guess there are certain grey areas on the conditions & the interpretations of those conditions governing a new WP at the border.

yes, well i'm not looking for any grey area. i'd like to know if it is absolutely doable. her TRV will only expire in 2013, so i guess she has until that expiry to be able to without a doubt be able to get this done at the border.

Based on the opinions expressed by members in this forum & their experiences I believe this is doable.

It is theoritically doable at any border US/Canada border crossing that has immigration services. I did it myself successfully.

In any case, your wife is legally authorized to re-enter Canada as long as she holds a non-expired work permit. If the border is close to the place where your wife lives, then it won't cost much to go there.
