That's correct.

If you entered US legally you can apply via Buffalo office. To proof your legal status and entry in US, you can submit a copy of your visa, I-94 (most important), DL license, work permit (if any), letter from school or employer, paystubs and tax return (if working). GOOD LUCK.

Immigrant, As far as I know, one has to be present in US to apply from the Buffalo office even if he/she is admitted legally. You can also apply from your home country in which case you don't have to be present there. Anyone, please correct me if I am wrong. GOOD LUCK.
