Work permit/study permit transition

Hi there,

If I transition from a closed work permit to a study permit, will I still be considered to have legal status in Canada for the purpose of receiving Employment Insurance (EI) benefits? I have been working full time 40h/week for two years and my work permit expires in Nov and I have been paying EI. I would appreciate your assistance!

I don't believe you would qualify for EI if you have to leave your job due to your work permit expiring. Wait for others to comment.

No you will not qualify. You have the ability to keep working under your study permit when you start studying but will have to reduce your work hours to 24 hours a week. As previously indicated you don’t qualify for EI if you can’t work because your WP ends or you change types of permits.

I hope you are all doing well, and I always appreciate your great smart responses to all the questions here in forum, you are helping a lot of applicants questions.

If for example a Work Permit Letter does not have any "Remarks/Observations and Conditions (except "Must leave Canada 2025/07/21"), does the Worker allowed to study without Study Permit as per "Public policy allowing some work permit holders to study without a study permit - that expires on June 27, 2026.

Details of the workers are as follows to see if eligible under the policy and the Work Permit no other Remarks/Observations and Conditions as mentioned above:

Work Visa applied on May 2023
Work Visa approved on June 2, 2023
Landed in Canada on July 22, 2023
Work Permit Letter issued on July 22, 2023
