Hi All,

Need advice,

I am planning to apply under Canadian experience class, as I am working from home in India for Canadian employer. I have an escrow bank account in Canada, where my employer deposit 12 month salary in advance and by end of every month, the salary gets credited to my indian account. I have appointment letter to work from India, while sitting at home.

Is above arrangement will help me to apply under "Canadian Experience Class".

Not sure if working outside Canada qualifies under CEC.

Nope because "The applicant must have held temporary resident status during the period of qualifying work experience acquired in Canada".

The only issue is my consultant asked me that he is sure about this. He can show the same as Canadian Experience class.

So, i was checking his whether he is correct at his place or not.

My points jumps to 450 from 360. Lets see, in other draw, what there in destiny and how consultant will prove this as CEC. Even I have the same view as you guys have.

Short of a work offer from Canada or you Doing a PhD your scores are gonna be what they are so I can see why you are ready for this approach.
However I would recommend you to check if your consultant is a "Regulated Canadian Immigration Consultant".
Because if he is RCIC then he should know what he is talking about. Ask him to explain these references to you R87.1(3)(c).

You must:
* have at least 12 months of full-time (or an equal amount in part-time) skilled work experience in Canada in the three years before you apply,
* have gained your experience in Canada with the proper authorization,
1st one requires you to gain experience in Canada. 2nd requires "proper authorization" (work permit) to work in Canada for the experience to count.
No way in hell working remotely from outside Canada would count.

Remember that ultimately you will be signing the paperwork and certifying it's true, not your consultant.

Best option for you: have your current company get you a work permit as an intra company transfer (no lmia required if there is a 'significant benefit') and once you work for a year apply for PR.

IF I say, can I gain points under Canadian experience (35 points). But not under Canadian experience Class. Does I sound correct?

So will that work?

If you didn't work in Canada you cannot claim points for Canadian experience. It would be misrepresentation. Working for Canadian company abroad is not Canadian experience. You should get rid of your consultant.

Your consultant is wrong. Claiming this as Canadian work experience would be misrepresentation (lying in your immigration application). Misrepresentation results in your application being refused and can also result in a five year ban from Canada.

Get a new consultant. The one you have now doesn't know what he's doing.

To claim Canadian experience you have to be physically in Canada and have a valid work permit.
