There's no guaranteed way to get H&C. Your lawyer should have explained your chances and you should understand that it's not a 100% guarantee. The only thing you can do is apply (with the help of a good lawyer), and hope for the best.

He says apply h & c coz I plan to leave and be gone to work driving truck across the country . That's what my brother in law says .
The lawyer is charging more than 10k if I will pursue. Should I Gamble and put my whole savings into it ?
My brother in law is putting me in a very difficult situation and he's whole family. I lost my job coz he don't want to support my sister doing treatment. And now I can't leave coz I can't get a good answer if he will stay or not and I'm running our of timecoz I need to restore my status .so i don't know.
None of us can made this decision for you. H&C is far from guaranteed - refusal rates are quite high.

Get a second opinion before spending all your savings. That's too much money and too much certainty from this lawyer. I would be careful - if you spend all your money and you don't get it, the lawyer can simply say "too bad", and you're out 10K.
If you're in Toronto/GTA there are many lawyers here. Spend some time finding someone whom you can trust. Don't go with the first one who promises the moon in exchange for a fat fee.
You also have to talk to your brother-in-law. These are his children and they are not your responsibility they are his. He should be reassessing his plans knowing he will become a single parent. I would not do everything for the children and try to get him to do some stuff. Perhaps there is a social worker at the children’s school and you could meet the 3 of you to discuss supporting the children through a difficult transition time. There may be a social worker at the cancer clinic if the school isn’t an option. Although you are doing all the caregiving, you aren’t their guardians which could create issues if you had to go to the doctor, sign school forms, etc.
Can I restore my visitor Visa before it expires ?. If h & c is not the way to go , I just want to extend my stay at least . My multiple entry will expire next year January.
He's plan is to make more money for his future and kids future he says, Which I don't think so its more of his future he's thinking here . He doesn't care anymore if my sister is still fighting or not he consider her dead already . IMO no lawyer should be saying that approval is 95%. I would get two other opinions.
like I said, get another opinion. Have proof of everything you are saying. That is my advice. 95% chance of success? I call bull on that lawyer. No one can guarantee 95%.
I don't want to sound heartless, but by your own admittance, it sounds like you are enabling your brother-in-law's irresponsibility. If you were to leave Canada, maybe it would force him to start taking care of the children. Because your sister's illness is terminal, she should be in hospice care through the province's health care system, so you don't have to be the one to take care of her. If you were just to extend your stay, you would just continue to enable your deadbeat brother-in-law, and others have already pointed out that by being your sister's and her children's caregiver without a work permit, you are essentially working in Canada illegally.
