Note that you are the one who will have to apply for the student visa - not your sister. Are you willing to attend school full time? You will need to be a full time student to get a visa approved.

Yes I'm willing to study . But we're just worried I will get refused since I have to apply it outside Canada . Coz she needs me to stay in case she pass away , she have a close family member nearby . My parents are too old to come here ,we don't want to risk their health and create another problem

At the risk of repeating myself...
Engage a professional. That's my best advice at this point in time.

Thank you guys for advices. Tomorrow I book an appointment to see an immigration lawyer. I will let you know what happened.

In all honesty, I think that you need to be working with a qualified Canadian immigration lawyer at this point.
Your case is complex and has a number of negative factors to consider, both for extension and the H&C aspect.
For example, if you have been providing child care services, you may also have been working illegally.

Can they remove my rights to be a lifeline of my sister? Family does more beyond duty especially in crisis like this . My sister we didn't expect she get worst from stage 3 to 4 and on palliative treatment.

Yes you could be denied an extension. You would then have to decide whether to overstay your visa or appeal the ruling. They are very very unlikely to come to your sister’s home in the next few months to forcibly remove you so I wouldn’t worry about that.

H&c is our only choice ? Will it give me guaranteed 1 yr to stay and take care of my sister since we will be waiting for a yr or more for the result .I'm doing this to help my family . And I don't want to leave and then she won't have any immediate family beside her if she pass away :(

Also you need to be communicating with your sister and her husband about the plans for the family if she passes away. The father is still their father so he needs to be involved in this discussion. It
Hi , I have seen a lawyer and he says i have a chance under h &c , should I pursue ?

It is up to you. There is still the issue that the father is alive and will have custody of the children if your sister dies. Unfortunately if your sister passes way theu still have a family member who is a PR or citizen. One of the reasons that you should be forcing the father to get more involved with his children. If you do everything he doesn't have to do anything.

Hi , I have seen a lawyer and he says i have a chance under h &c , should I pursue ?

i would suggest getting a second opinion and seeing if the other lawyer says the same and has the same idea of how he or she could help ensure your success.

as others have mentioned, your sister has a husband. I get the family bond and i am sure whoever is assigned to review your case should you pursue it will also feel for you but the root of the matter is, is it enough to grant you PR? The visa officer will need to determine if you getting permanent residency is absolutely needed. If your sister is terminal and the reason you want to stay is to be with her until she passes, why should you be granted PERMANENT residence? Please note this is in no way an attack on you but the logical train of thought any visa officer will have. You are not needed in Canada permanently, this is a fact. Your sister has immediate family in Canada since the husband and children are here, this is a fact. I don’t know you nor the husband and i don’t know the actual facts to your claims that he is being neglectful. Ensure you have proof ready for that also should you decide to file an H&C app.

So it's like he wants to leave the kids and his wife responsibility to me and he wants to work to save for his future .I'm not sure if he will support them though. He plans to leave his family
