Hello I have a friend who lived in the US for 20+ years and he came to Canada through the border and claimed the refugee status. He is from a South american country and says his life is at risk there. But during the 20+ years in the US he had kids. And those kids are American citizens. They all came to Canada including his wife. What are the chances they get to stay in Canada? They are awaiting the results from the hearing
 
As he has been living in the US for a long time, how does he plan to prove his grounds for asylum from his home country?

His American kids (and wife?) have no chance unless they have solid and undeniable proof of persecution in the US, even with proof, their chance goes up to about 1% only.

Overall, I don’t see a good chance based on what I’ve seen so far but we never say never. Without the full story, really difficult to tell.

Yes it's what i've been thinking too many years in the US without status and his wife is also in the same boat as him. Only the kids are American citizens. The only thing I know is that their life could be at risk in their country of origin. Thanks for the reply
 
This is the perfect example of why people should consult an immigration lawyer before applying for asylum. The goal was to avoid deportation but they may actually be much closer to deportation in Canada vs the US. Depending on the province, the children will not be able to access healthcare or schooling.

I say kids because I'm used to but they are young adults
 
If they are under 22 they are dependents of their parents. They would still be US citizens visiting Canada but they will have to find their own way to immigrate to Canada.
Interesting. I think last I heard the kids were going back to the States but I wonder if the parents have a chance. Couldn't their kids apply in the US for family reunification?
 
If they are adults 22 and older their parents can't sponsor them for PR. Not familiar with US immigration law but I know the parents now have a 10 year exclusion from the US for living there illegally. Did they consult a lawyer before coming to Canada?

No, they fled the US because of fear of deportation and like most desperate people hearing misinformation came to Canada hoping to stay here. They've been here for a while now, they recently had their hearing and now awaiting a response.

They need a Plan C. Very high chance the Canadian refugee claim is going to be refused - and going back to the U.S. isn't feasible for him.

That's what I told them. I wish people would get informed before making a big decision like this.

They will have to see. We have seen others in similar situation being denied but you never know. They must be concerned about refusal if you are asking these questions. People who have spread incorrect information about getting asylum in Canada have really done a diservice to their communities.

Yes they are very scared. I work with him and he's always concerned about this situation. I agree with you, it;s kinda cruel in some way.
