Ok so my hubby is currently on a Visitors visa(?) for 6 months which ends Sept 1 2010. We are sending in PR app any day now (like 1 or 2). He is also going to ask for another extension of 6 months. If he gets refused :( he will go back to the USA for a bit. How long after he goes back does he have to wait until he can come and visit me again?

I don't think there is any fixed time to "stay away". I have friends who have done the round-the-flagpole thing and got back in, though they were just backpacking. I wouldn't try it personally though!

I wouldn't worry too much about being refused - you need to explain that you have filed the PR package which I believe helps a lot.

We applied for a 1 week extension (a return visit to the US was scheduled for approx. one week beyond the 6 month limit of entry) to keep everything legal, and explained that the PR application was in process. Though it took a very long time to get a reply, what finally came was a nice piece of paper extending it for a full 12 months. Unfortunately as a one time use visa, it was already overridden by the visit to the US and subsequent return to Canada (to visit while waiting for the PR process to run its course).

To answer the second question, my understanding is that you need to return to the US for 48 hrs before coming back across the border for a new 6 month visit.

I wouldnt worry too much as your Husband is from a Visa Exempt Country..I extended my Visit in May 2009 and was issued 1 year until Aug 2010 - I explained that I was applying for PR, I have re-extended my VR and been given another year until Aug 2011..However if I have to leave for an interview in London UK I am sure my VR will be void and I will come back to Canada on another "6 month Implied status". Unless there is a problem with admissibility I would be surprised if your Husband will get denied either and extension or another 6 month status if he flagpoles! Yes 48 hours is required before coming back into Canada..

You should hear within a week or 2! I applied 13 May for mine and Got my VR last week..they take about 62 days in total

Not necessarily. My partner and I just went on a weekend visit to the U.S. The officer at the border looked at his visitor record, asked a couple of questions, and waved us through. He's still on that V.R.

It is highly probable that they will grant the extension, based on the PR application in process. There are no actual regulations stating how long an American visitor can visit Canada, but in practice it is normally 6 months and the principle would suggest that there shouldn't "normally" be more than 6 months of "visiting" out of one year; otherwise, it's more like they're living in Canada and "visiting" the U.S. All that being said, this is not a "normal" (i.e. typical) visit of an American to Canada. It's up to the discretion of the officer at the border, really. But I don't think you will have this problem anyway. He will get his extension.

Thats good to know..Hopefully because I would have been summoned to the UK for an interview I will be able to resume my V.R too...We would be gone for a total of 3 days only...I know if I go to the US for a day or 2 it doesnt affect my V.R

ty all for replying. I pray he can stay at least another 6 months. I really want to have Christmas together. I'll be lost if he leaves :( Anyhow app for pr should be going out very very soon,followed closely with extension. I'll keep everyone posted of course! lol

I just received note of my extension today in the mail. I applied for it in mid-may and received the official form today to say it has been granted for a further 6 months :) I think it is very probable your extension will be granted too

9 times out of 10 for a visa expemt country they'll give enough time on the visa to process the PR app so 12 months is standard,

Congrats :D Did you ask for 6 months? Or is that all CPC-V gave you? Such a relief when the document comes through the mail and not a letter :D

Good luck, CPC-V usually grant Extensions unless;

- there is an admissibility issue
or
- You do not show enough proof of funds!

I am sure you will get 1 year :D
