hi there. My friend is supposed to get married in January in US. She came from New Zealand (work permit visa holder), she already quit her job in New Zealand, the problem is the immigration officer in US questioned her and only allow her to stay for 1 month. She’s only holding a regular US visit visa (not fiance visa). Can she apply a canada visitor’s visa and stay here for couple of months till her wedding day? Thanks

Is your friend already in USA? If so, how would she re enter USA?

She can apply for Canada Visa but that can easily take a month. And she could likely go through a similar process (of being allowed for a specific duration)

Hi. Thanks for your reply. Yes she’s already in US. But was given only 1 month. That’s what she’s worried about too. If she gets questioned again if she re enter US. The husband to be is thinking to apply canada visit visa because it’s near US rather than going back to Philippines. She already quit her job in New Zealand so she wont be able to come back

As she is already in the US the issue is likely going to be the processing time, the fact she needs to arrange for biometrics and that she is applying from outside her home country all can affect the processing time so odds of approval whilst in the US seem low.

To apply for a Canada visit visa an applicant needs to have a strong case for why they want to visit, applying from outside home country complicates this as need to be convincing will leave Canada at the end of any visit. Given she is not a legal resident of the US but just a visitor with no guarantee of reentry then seems leaving back for the Phillipines would be the expectation at end of any visit.

Even should a Canada visa be issued there is no guarantee given purpose of visit she would be granted a 2/3 month stay at the border plus of course no guarantee that the US will allow her entry back into the US given her previous restricted entry/reason for entry.

Ensuring leave the US on time and returning to the home country to wait out the time might in the end be the only option, returning to the US for the January wedding hoping the US allows her in again.

Above only my personal view and others can of course add comments/views

thanks for replying. Yes, i agree. The best option is to go back home to avoid more complications in the future.
