Hello,

I am currently living in canada, sponsoring my husband who is residing in US for the last 5-6 years. I am already approved as sponsor and our file has been transfered to Buffalo last week. We submitted the FBI PCC for him with our application but not the state police clearance.

1. How long is the FBI PCC valid ? We got it on Nov 15, 2010.
2. Is the State Police Clearance required? He has been in Michigan... looking at other threads, I guess we should have. Should we get it done now for my husband and send it with reference to my client ID and the Kit # they provided in the letter of sponsorship approval ?

I asked this also and the answer was basically wait and see if Buffalo asks for the state check. Also The FBI should be sent less than three months from when you got it but you are probably ok there too.
 
The FBI clearance is valid for 3 months from the date it was issued. As long as Missisauga received your application within that time you should be ok. State certificates are generally only needed if there are issue with potential criminality. My husband had a DUI in 98 and we were asked to submit a state police check and court documents. Our application wouldn't have been held up if we had submitted those with the original package.
 
Okay ! So I guess we will be good for the FBI clearance. And I will wait if the Buffalo embassy requests for the State PCC. I was just wondering if they do that more often so maybe we should just get it done anyway to avoid any further delays. But my husband hasn't had any criminal records, so hopefully they won't request one for him.

Sparkle, if it makes you feel any better, you can always do what I did, and get another FBI background check done. Then you'll have it ready to immediately mail in, should Buffalo request it. You can also do the same with your state police certificate. It'll give you something to do, and who knows, perhaps by the time the new FBI and state background checks come in the mail, you'll already have PPR! :)

I did not do my police certificates for states I lived in, I was never asked to provide them. The FBI certificates took about 3 months for me to get. My partner called the FBI and spoke with a lady at about 2AM and she was very helpful. She actually went and pulled my file and processed them the same night and sent them out the next day. Don't be afraid to call the FBI, there were extremely polite and helpful every time we called.

If you call the FBI they will help you and assist you in any way they can.

I was very fortune and my FBI background check took lest than 12 weeks.

I spoke with them several times, explaining the situation and I believed someone helped me and rushed the paperwork.
