thanks. I am planning on applying outland. OK. How do I go about asking for his CBSA and CBP records? Does that take a long time to receive?

For CBSA it is an ATIP request: http://www.cbsa-asfc.gc.ca/agency-agence/reports-rapports/pia-efvp/atip-aiprp/req-dem-info-eng.html

For CBP it is a FOIA request: https://help.cbp.gov/app/answers/detail/a_id/976/~/record-of-my-travel-in-and-out-of-the-united-states,-foia

Both take a lot of time to get, so my suggestion would be to order them now or no later than the same time as you submit the application. Then if the visa office wants further evidence, you'll have those reports back and can submit them. If they don't want them, it won't matter.

Also, is it OK if he continues to go back and forth while our outland application is on-going? I don't want him to get in trouble ....

Of course. He needs to be clear he's only visiting while his PR application is in process. He should have a copy of the payment receipt (at least) and the sponsor approval letter once you get it. Having a copy of the application is a good idea as well, but not required.

If he qualifies for a NAFTA position, he could get a work permit rather trivially. NAFTA covers a broad range of management/technical/professional jobs. Having a work permit for Canada also means that his time in Canada counts towards citizenship (at 50%) while visitor time does not.

Good luck!

Wow. thank you so much. You guys/gals are awesome. I was thinking about sending in a "Declaration of common-law"? If so, do I get this from a lawyer's office? I live in Ontario. thank you.

I know (unless they've changed it recently) that the CIC website has a Statutory declaration form, so no need to go through the town or province. Anyone feel free to correct me or add to this :)

Hello again. It looks like this form needs to be witnessed by someone? Would a notary be in a position to do this for us?

Also, Form 5490 question #27 - what do I answer there? We never officially lived together, as we both have separate residences, but as long as my common-law husband was visiting me, we lived together as if we were married. So do we say no, and explain..... tks

Has anyone had any issues at the border when visiting their U.S. spouse? CBP can be scary enough to deal with at times. I'm afraid of what they might put me through once I'm married to an American, even though I have no intentions of ever residing in the U.S. Any advice?

Yes, it's always best to carry "proof" with you that you are only visiting. I used to carry my paystubs (to prove I had a job), rental agreements/mortgage document, and a copy of your application to CIC for your spouse to come to Canada. I sometimes had the US Border guard ask more questions than other times, but always carry lots of proof of strong ties to Canada and answer all their questions straightforwardly and truthfully, but without elaborating or volunteering information. We all know there are no guarantees, but you should be fine.

Hi Everyone!

I have been posting in the January applicants thread, but I thought I would this forum might be more appropriate since I am in the same situation as you all!

I am an American citizen who married my Canadian husband in September (in the states). I am currently in Vancouver on a visitors visa, and we FINALLY sent our application yesterday - looks like it arrived in Mississauga today! We applied outland. My meds were done on January 8th and our Visa office is Seattle.

...Now the waiting game starts ;D

Congrats! Good luck with your application!
P.S. Just so you know your Visa Office is Ottawa (we chuckle here that CIC considers Ottawa a "foreign visa office", but almost all US applications now go through Ottawa, unless CIC lets you know your application has been transferred to a different office.)

If any of you guys are interested, there's been a lot of movement lately by Ottawa and it seems that people who applied in July are starting to get PPRs! How awesome is that? Check out the CPP Ottawa thread and the Ottawa spreadsheet(link in my signature if you need it) to see it with your own eyeballs =D

Oh - I must have got that confused- YES Ottawa is my office! :)fingers crossed that the process will be quick!

Wondering if I should be concerned....I keep reading people's apps as "In Process" for those also in the Sept 2012 thread. Ecas still shows "We received xxx's application for permanent residence on September 24, 2012."

So, no movement at ALL. Is this normal? Why do they show my app rec'd the date it was rec'd in Mississaqua for Sponsorship approval?Sponosorship was approved Nov 2nd...

I'm a July applicant and ours still says application received and it's the date the application submitted as opposed to the date the sponsor was approved.

Sometimes they don't even update it to in progress, so I don't think it's anything to worry about :)

May applicant that still says application received. Seems it isn't to accurate, but I still check it! LOL
