we are family of three already candian pr holder since 2010

my son is 10 years old and has mild autism. I read some articles where they dont allow autistic person.

In 2010 , we did our medical and in medical no one asked us about the child autism.

if we come to canada will this cause an issue ? in india in school he doesnt need any help but as he is slow learner teacher allow him some special concessions.


I read some articles where they deport whole 'Kim' family in year 2012. But looking at whole story his son was very much dependent on school aid. I dont think so that will be our case. but yes when when you hear Autism it rings bell.

My Q
Is this new Q in IMM 5419 form?
as at our time Dr did not even asked us about Autism etc.

If we come to Toronto, VC will that cause any issue on renewal of PR

Pls guide

You never tried to hide that your son is autistic and he passed the medicals and you already have the PR so you have no need to worry. Just make sure you meet your residency obligation of 2 years in Canada in every 5. If you are outside Canada since you landed in 2010, it is about time you come back so you can complete your 2 years before your first 5 years as a PR are up. Not meeting your residency obligation can cause your whole family to lose their PR.

The situation of the Kim family is different because they did not have PR already and their child did not pass the medicals.

See this is something tricky, In 2010 .
As mentioned in my note when we did our medical and in medical no one asked us about the child autism. We were honest but while and since last 2 years it never occurred to us to highlight till I read Kims news.
The country where I stay they dont provide special assistance. infact autism is new word here.

As compared to our country in Canada they take much care about children (and I appreciate that). If school or any authority asks us about taking government aid and we increase certain amount 5000 CND Dllrs then we three of us may loose canadian PR. so worried.

I am very much aware of 730 days and so planning to make move along with family.

So my Q, am i just over worring? or should I take extra take care ?

Like I explained, the Kim family has a different situation completely because:

1. They did not have PR already

2. They had applied for PR but their child failed the medicals

3. Because their child failed the medicals, they were refused their PR

4. They had to leave because you can only say a certain number of years on a work permit without either getting a PR or leaving.

I can guarantee you that nobody ever lost their PR because they ended up costing Canada more than $5000 after they got their PR already. This is only checked during the medicals when you apply for PR, not afterwards.

One way somebody might lose their PR is if they committed misrepresentation, that is lied or tried to hide something from immigration during their PR application. You did not do this because you never tried to hide the fact that your child has autism. Your child passed the medicals and you already got your PR so as long as you make sure you fulfill your residency obligation in Canada, you have nothing to worry about.

Hi Leon. I would be really thankful if you could please provide your expert advice on this.

We had our medicals in London UK today (myself, wife and 2 sons), and the doctor said my youngest son seems to have a mild Autism which we are already aware of. She also said she will let immigration know about it and they will contact us.

Please can you let me know what to expect next and how much chance we have of getting the visas. I applied for federal under the Quebec program.

There is often a problem with medicals for children who have any kind of disability. Depending on how serious it is and the future prognosis, you may be asked for specialist reports and re-medicals and depending on how that goes, they will decide if they will allow you to immigrate or not. There is unfortunately not much you can do about it but do what the doctor tells you and wait.
