I posted a few days ago regarding a situation with my sister marriage and there has been some change of circumstances. Therefore I'm asking this question. My sister who is a Canadian citizen is engaged to someone who is in the US. He entered the US in 2016 with an F1 student visa. He dropped out of school and therefore I assume is counted now as an illegal alien or staying illegally within the states. My question is would anyone know if they be able to marry in the US (in New York)?

Also, if and when we decide to apply for his spousal pr, would he be eligible for the temporary visit visa so that we can apply in land?


If we decide to do Outland sponsorship can he apply from the US or will he have to return to Pakistan (his original passport country)?

We are telling him to reapply into a school so that he can have some sort of status but we like doing things the legal way. So this situation has clearly raised some questions for us but I'd like to know so we can make a decision accordingly.

Any additional information or tips that anyone can provided would be greatly appreciated.

I'll help with a few questions.

Without legal status in the US, there's pretty much zero chance a TRV (visitor visa) will be approved. I honestly wouldn't even bother applying. Since he's out of status in the US, he can expect the outland application will be processed through Pakistan. If an interview is required - it will be held in Pakistan as well.

He should leave the US before he has been out of status for six months. Once he hits the six month mark, he'll end up being banned from the US for several years once he leaves.
 
Do you know if a marriage between my sister and him is possible in the states or would we have to go through the marriage in Pakistan?


We are suggesting he some how renew his study visa or re apply but let's see what happens.

This situation has become very complicated especially with the current situation in the states as well.
