Hello everyone

Here is the situation:

I came to Canada from Russia as a student in Jan 2010 and finished 1 year Graduate Certificate Program in the College (8 months studies and 4 months Co-Op) after that I got 1 year post grad open work permit which expires in Jan 2012.
In Feb 2011 I got a job where I've been working till now.

I have a girlfriend in Russia whom I know since October 2009.

She applied for TRV to come to Canada to study English (6 months program in Language school - 3 months studies + 3 months internship) in March 2011. We were planning that she will come here and we will get married and she would be able to stay as my wife. BUT the application was declined. The thing is that she haven't finished university but already started working as a marketing specialist in Russia and she also didn't have any property in Russia so the embassy considered that she doesn't have enough ties to motherland and also doesn't have enough money to support herself in Canada and therefore in got declined.

In June 2011 I went to Russia and married her.

Now the question is that if she will apply now as my wife (spouse of the foreign worker) then is it possible that it will be considered as a fraud and if it is possible then what can I do to minimize the risk?

It is very important for me because we cannot live any longer being apart. It was already to much of this kind of living. So I would appreciate any help in this case.

I'm trying to understand your case. You got married in June 2001 . When you want to go back to Canada, as a student,tourist or other ? To answer you correctly, i need to know everything. 8)

As far as I know, You can apply for dependent visa for your spouse..

I got married in June 2011 and I'm already back to Canada and continue to work here.
But now I just want to bring my wife here!

The thing is that I know that by immigration rules I can bring my wife as a spouse of the foreign worker.

But considering the whole story I just wanted to know in practice will they consider this application as a fraud and if yes then how to avoid it?

Spousal fraud cases is the new program that the minister immigration has put forward ..... but that program only applies on immigration sponsorship of spouse .......... So if u dont do that ..... it does not apply to u ......

Do this :

> call her on visit visa ..... as wife wants to visit husband .....
> 2nd thing when she comes here .... you are legally allowed to file her workpermit as ...... they allow spouse to work if husband is studying or working ........
> When she gets work permit she can stay longer over here .... now apply for immigration together ...........

somebody told me that the rules that are written on CIC website not necessarily work in practice.

The thing is that considering previous refusal of visa for my wife (when she was not my wife yet) the immigration officer may suspect that she wants to get visa by any means just to get to the country to stay there illegally or apply for refugee status and that's why she found me to get married and come to Canada using spousal visa.

That's why I'm asking what the practice is and not what the rules are?

dont u think its the same situation in every case... which is filed....... they always are looking for things ........ but it totally depends on what was the previous reason for rejection ...........like
if she misled with some faulse information then there are chances it might get rejected ..........
but if they rejected on the basis like they dont think she needs to be here or they think that she will apply refugee in canada ...............then they will issue visa .... chance are 80% that she will get visa .......

Secondly ....... u should not be worried much ........ coz u hav no choice right now ..... do u ? ..........
lets suppose worst case scenario .............. wen they reject her coz they think she will go for refugee status ....... u can hire a lawyer in toronto ....... and in couple of months ur case would bring positive results .......there are so many lawyers who are doing these cases on daily basis .............
relax and apply ......... best of luck
