Hi
We landed in Canada on nov 4th 2010 and left within a month after receiving the pr cards.
We had a new baby in 2012 outside Canada. To move completely to Canada I myself travelled to Canada in July 2013 and got a job and applied for sponsoring my last baby in August 2013. However we received the passport stamped only in last April 2014.

We plan to travel together to Canada coming June 2014. The question is my wife and the older 3 kids have been out of Canada since dec 2010. We definitely lack the days for renewing the pr card .
Will there be any issues? What questions will the cbsa officers ask?

There's no black and white answer. They may run into issues or they may enter without any problems. It really depends on the individual immigration officer they encounter. If they enter without any issues then then should remain in Canada without leaving until they meet RO. If they are reported, they will have to appear in front of a judge to argue why they should be allowed to keep their PR status even though they have failed to meet RO. Again, unfortunately it's impossible to say what will happen. However chances are higher they will be allowed in with no issues (lower chance they will be reported).

How do we know that they are reported? Was hoping to pass the info to my wife to give them all scenario.

They will be given some kind of paperwork by the immigration officer if they are reported.

You will be issued a departure order that has the inadmissibility reason/s as well as your bio data and photograph - you sign it and get your own copy!

Is it advisable to use the lane for electronic kiosk which scans the PR card and let's you in?

While I was returning in July 2013 , I did not choose this electronic lane. I went up to the CBSA officer and had answered that I was returning after 1 year. He marked on my immigration card and On my way out I was directed to another officer inside who asked me several questions and noted it down and entering it in the system. Later she took my passport and stamped Entry and physically wrote out since dec 2010
At that time she had asked me about my family and I mentioned that they are outside Canada . So they should have that info in the system too.

My question is to get my family in without getting reported. Not to mention they are traveling with my new born baby whom I sponsored from here and possess a valid COPR.
Please advise.

It doesn't matter which process you use. You will have to speak with an agent one way or another because your youngest son is landing.

Make sure your family is truthful when they answer the questions on the customs declaration card. Lying can only make existing problems worse.

scylla on point. They will get sent to Secondary Inspection regardless so there is no 'we will get in easier via the automated gates' route. There will be entries too on the database of their absences as you provided the info. If they get reported which seems unlikely then they can relinquish PR and you can re-sponsor but why don't you let the landing process take place first...you seem to have had good luck until now.

Thanks for the info, I have cleared my confusion on secondary inspection.

Do you suggest me to leave to India, and re enter Canada with all my family, Divide the members in two groups ; Me and my three older kids via electronic gates and my wife and the new born with landing papers meet with the officers.

In this way I could get in with my kids not going to secondary inspection. Any advise is welcome.

I think it is better for you to travel as a family than to split up. When you are faced with the immigration officer, explain that your family had to wait outside Canada with your non-PR baby while you took care of the sponsorship and this prevented them from acquiring the required number of days.

I don't think it is likely to be reported with such reasons. If they do get reported, they can appeal. They will be allowed to enter Canada and remain PR's while the appeal is being processed. Worst case, if they lose their appeal and their PR's, you can sponsor them again.

CBSA know you are en-route when your flight departs India (mandatory provision of flight manifests) so they will be waiting for your family and all of you will go to Secondary Inspection...sorry the border isn't where you play games with the system. In fact if you try this you may find any sympathy they had goes out the window. In any case your FOSS has the entry about your previous absence so you will likely get referred to Secondary anyway. If you meet the RO relax - Secondary Inspection will likely be all ok with the absences and as has been pointed out if the worst happens with a report just re-sponsor. Just for information.
If anyone here has used the electronic gate at POE, can you please advise if the passport was stamped by the officer while exiting the lane or only the PR card is swiped and nothing else.
