Transition from tourist visa to open work permit

I am coming to Canada to do my Phd in August 2013. My partner and I are getting married in January. Can he come over on a tourist visa for the months between August and December, and then once we are married, qualify for an open work permit, since he is my spouse?

Would he have to leave Canada whilst waiting for the open work permit to be processed?

Asking for a visitor visa with intention to get married is a misrepresentation from CIC point of view. You will have troubles with your wife's immigration status.
