This is not the case. The rules are clear, and they state that a Canadian Citizen living abroad can sponsor their spouse under spousal sponsorship to Canada and the only additional requirement in the application will be proving to the VO that once permanent residence is granted to the spouse both the sponsor and applicant will reside in Canada.

Below you will find the actual Immigration Regulation.

A. Who may act as a “sponsor”?
A person is not eligible to be a sponsor until they have met all of the requirements in sections
130 and 133 of the Regulations. The requirements are summarized as follows:
1. The person must be a Canadian citizen or permanent resident who:
 is at least 18 years of age;
 has filed a sponsorship application in respect of a member of the family
class; and
 resides in Canada*;

Note: * A Canadian citizen who does not reside in Canada may sponsor an application for their spouse, common law partner, conjugal partner, or dependent child who has no dependent children if the Canadian will reside in Canada when the applicant becomes a permanent resident.


There is absolutely no mention of special circumstances for a Canadian Citizen having to work for a Canadian company abroad.

Jomz is 100% correct. A Canadian citizen sponsor can reside outside Canada for the whole period of the sponsorship application AND may continue to reside outside Canada after the applicant has been granted PR status by "landing".

The ONLY requirement is that the Canadian citizen has to demonstrate an intent to return to Canada after, or at the same time as, the sponsored applicant has been "landed". This "intent" is not enforced but must be demonstrated as part of the application.

Finally, the applicant will have any days outside Canada, while accompanying their Canadian citizen partner, treated as "in Canada" days for PR residency purposes, but not for citizenship purposes.

The information provided by ANigerian is, unfortunately, erroneous..

If you have no family information to update, you don't need to redo the IMM8 form, right?

For visa pick up, is this interpretation correct...?

These requirements vary country to country. Best to check the invitation letter from the visa office as it will list what needs to be provided for the visa issuance.

In your application you can most definately put down London as the VO, however in the end it will be the decision by CPC- Missisauga as to where they will forward the application.
Thank you for all your advice on this matter. It appears there will be no issue for me to apply as the sponsor while we live in the UK because I am just here on a work visa and remain a resident of Canada and have proof of where we will reside when I return.

CPC - Mississauga will decide where they will forward the application, that is where it gets complicated. We are only here until September 2014 then I am hoping my husband will be able to join me in Canada right after. My only concern is having to pay for unnecessary flights to Ghana. If they process his application in Accra, my husband will have to fly for the interview (unless it gets waived) and/or to get the visa (or maybe he could mail his passport?).

I guess I will try and call CPC and see if they can provide any insight about where they would send the application for processing...and then we could decide if it would make more sense to apply later and then my husband can wait it out in Ghana. Would just hate to prolong the process when we could just try and apply now....

Hey! any news or update? The anxiety is killing me here. I am running out of explanation to my In-laws. I go through everyday with the hope that it'll be today and the waiting will be over. I seize every moment to check online. I pray and hope we get a response soooonest!

The delays have been incredibly stressful and distressing and I am still uncertain whether I will be able to see my wife anytime soon. The worst aspect of it that we cannot even track the application. Even if you order a pizza from Domino's you can track its progress - but I've no idea about what's happening to my application.

This answer depends on your case, but I will say get a letter from both parents, add more call list from both parties and newspaper publication.
but if your case has little issue then get a legal personal to reply them.
