Hi,
I'm 24 years old and am from California, US. My fiancée is from Montreal, QC in Canada. We've been together for over 3 years. I currently have a criminal record and recently was just released from probation. I completed all required programs and paid all fines. I have all the documentation as far as FBI background check, police certificate, a DMV printout, a letter from my former probation officer, letters from former employers and from the bishop of my church. All my identification documents are valid.

My question is, with my probation ending not that long ago, would I still be eligible for a temporary resident’s permit given that I provided as much documentation about my previous history or even have a chance at being granted at the boarder. Also is me visiting my fiancée a good enough reason for them to grant me access into the country.

In order to get a better reply, you'll need to tell us what you were convicted of and what degree if applicable.

Here is the general information on Criminal Inadmissibility. Canada takes it seriously. Anything that could get you ten years in a Canadian prison will make you automatically inadmissible.

If your offense was inadmissible to Canada, generally you would need to wait 5 years before visiting.

Thanks for the response.

I was convicted of Possession with intent to sell of a controlled substance, and another possession charge. I completed rehab which was 6 months and was sentenced to be on probation for 3 years. I paid my fines that I owed and my probation officer recommended me for early termination of probation. I am now working on going to court to reduce my charges to misdemeanors or possibly having them dismissed.

If my fiancée was able to get me a job working with her company and I had documents showing potential employment, would it better my chances?

1. You are inadmissible as a visitor or any other category. You can't apply for rehabilitation until 5 years have passed since the completion of your sentence (probation). You could apply for a Temporary Resident Permit, but it has to be for "exceptional circumstances" http://www.cic.gc.ca/english/information/inadmissibility/permits.asp

I've read that but was told different by someone from canadavisa's immigration services. I don't want to be misled to spend $1500 to get help getting my documents prepared and legal backing from canadavisa, when really there isn't a chance to begin with.

Even if I was to get my record and felonies expunged am I still inadmissible?
