If my wife suffered a subdural hematoma recently from which she has recovered, and has a doctor's certificate which shows this, and on the application we state that she suffered a mental or physical disability and explain her subsequent recovery, is that sufficient?
Will CIC require more documentation? Will she require an interview to show that she is capable, and recovered?

I hope my question is clear, I'm not sure how to explain my concerns.

Hi,

In my opinion, even if you are giving a certification from her doctor about her treated Subdural Hematoma, as you mentioned, she may have to go through the usual medical examination, if CIC make a decision. In that situation making any other statemets regarding her condiion will not be sufficient and helpful. Once she appear for medical with DMP she has to produce the history of her treatments. The DMP may refer to a specialist opinion and further investigations like CT Scan or MRI. Any further requirements from CIC will be based on the DMP's medical report.

If the DMP decides she needs further treatment then they may refer her to a specialist for her own safety or health. But it will NOT affect your application. Spousal applicants are exempt from the "excess demand" clause which means that their application cannot be denied on the basis of having a medical condition that may place excess demand on the medical or social system. The ONLY way that your spouse can be refused is if they have a communicable disease such as active TB or syphilis or if they have a psychiatric condition which may make them a danger to the public. In all other cases, the application will be approved. Good luck.

Hey !
I had a heart surgery before couple of years ago, and my medical went well, because the problem was treated and now I am fine. Same with SH, if it is resolved, it does not pose any threat to you wife's well being,,,because it is treated and she is fine! =))
So you should not worry about it!

Thank you. Jo has been to see the DMP and he didn't express any concerns. However, I'm more concerned she may have to go through the interview process.
This brain injury has left her with some problems which would make an interview very difficult for her. Memory is inconsistent. Some difficulty to express herself, both in her native language and English.

The best way to avoid an interview is to make sure that you submit with the original application strong, quality evidence of the development and continuing nature of your genuine relationship. A "genuine relationship", in immigration terms, is one that has not been entered into to facilitate the entry of the foreign national to Canada. Interviews are most often requested when there are doubts about the genuine relationship . . . these can be because of a lack of support evidence, or because of "risk factors" like a huge age difference, language barriers, or a relationship that's not credible because it flies in the face of "cultural norms" - like a 27 yr old previously unmarried man from the Middle East marrying a 62 year old, divorced Canadian woman. If your relationship doesn't fit into any of the typical areas of concern, and you submit strong evidence that you are a genuine couple, you'll likely avoid an interview.

Thank you RobsLuv. That is reassuring. There should be no problems as we have many pictures, letters and entry/exit stamps from both our passports which show we've been together 4 years. We have so much already I didn't bother to print any emails. Again, thanks!
