This is Canada. As long as you're legal adults, it's not your parents' business what you do. Don't tell them and don't say anything. Although if the parents were claiming her as a depedant on their taxes, they will have to know sooner or later (say by end of the year) so they can file their taxes correctly.

Once she is married, she cannot depend on them AND you. So they will have to know before the end of the year so that neither you two or them get some big fines for "lying" to government.

Leon, I have trouble making dicision of where to send my application. Please help me understand. Im residing in canada married to a canadian citizen.im trying to gather all the documents for inland application but I have read that inland will take longer than applying outland. .so if om going to apply outland is my application goes to Manila visa office after mailing to Missisauga or theres another VO to choose.? Im so confused now.please help me.

Thank you
If you apply via the Outland route, the application is sent to CPC-M (Mississauga) and they will forward it along to Manila after sponsor approval.

If you apply via the Inland route, the application is sent to CPC-V (Vegreville) and they will process the entire application there (or forward it to an inland office if special processing is required).

Note the forms are somewhat different between these two routes.

If you want to learn about taxes, visit Revenue Canada's website.

Basically, if she's a student, her parents are claiming her as a dependant. If she is married to you, she cannot be a dependant of her parents. Her parents must know in order to file their taxes correctly. If she files as married and they file with her a dependant, it will flag and something will have to be worked out. She cannot lie and say she's not married either. That's committing tax fraud. So by the beginning of next year, around Jan 2014, she will need to inform her parents she can no longer be claimed on their taxes.

Unless she wants them to find out by CRA notifying them of an ineligible dependant and/or auditing them.

You should probably find out if she's a dependant on her parents' taxes first then worry about what to do.

She's a student and living with them? Then she's their dependent on their taxes. That's how you figure it out. So she will have to tell them by the end of the year.

Immigration will see a red flag if she tries to sponsor you but it comes out that she is still living at her parents who don't even know that she is married. If she is really in love with you and wants to marry you, she should stand up to her parents, even if it means not living with them any more. She must face them sooner or later anyway.

Look, there is no way around filing taxes properly unless you want to commit tax fraud. Throwing her parents under the bus like that would be horrible. They will already be hurt to find out she's married without their knowledge, then to have to pay penalties for filing taxes wrong? That's just cruel.

You will have to make the decision either to get married and tell her parents by Jan 2014 or not get married and wait until she's independant.

You need to accept her parents will find out one way or the other. You also need to question yourselves. If she's not mature enough to tell her parents, is she really ready to be a wife? Probably not.

That's fine, but she may have to tell them not to claim her.

I recently got married and my wife is on student visa right now which is expiring in September. Does below quoted paragraph mean she can stay with me in Canada without any kind of legal status after September if I've applied for her Inland sponsorship by then? Or it only mean we are eligible to apply inland and she may have to go back to Country of her Citizenship?

If we apply Outland:
  • Can she still stay with me in Canada? or she has to go live in country from where we are applying?
  • Is there any way she can stay with me in Canada without enrolling her into study?

Application for Permanent Residence from within Canada – Spouse or Common-law Partner in Canada class (IMM 5289)

Maintaining legal status

Spouses and common‑law partners of Canadian citizens and permanent residents in Canada who wish to
apply for permanent resident status are no longer required to have legal immigration status provided
that they have an eligible sponsor. All other eligibility requirements continue to apply.
Important information. Applicants who wish to be able to continue to work and study in Canada
must submit an application for extension before the work or study permit expires.
