one question though if my spouse is in canada and we apply outland can he apply for an open work permit as well...
i was wondering coz for philippines first stage approval is 55 days and in canada it is 11 months and his work permit expires on may 2015... thanks for future help everyone :)

There is no OWP with the Outland process. However, if you applied today, it is likely that a PR application would be done in that time frame (11 months) since Manila processes fairly quickly.

This assumes you are applying for the "spouse/partner in Canada class". If so, there is a form to extend your stay or change conditions as a worker. That's the form to use for an Open Work Permit. http://www.cic.gc.ca/english/information/applications/extend-worker.asp

You will need to renew your passport, but that is not necessary to initiate the application process. It will be required in order to get your open work permit beyond the expiration date of your passport. Since you are only 8 months away, I'd suggest you start working on the renewal.

Two comments: (1) you should probably apply via Outland. Manila will give you PR by the time you get AIP. However, with this route there is a risk that you won't have PR by the time your work permit expires, in which case you will need to stop working (you can apply to remain in Canada as a visitor). (2) If you have been working in Canada for 12 months or longer in a NOC O, A or B job, you would qualify for immigration in the CEC category. Applying in this category would permit you to apply for a "bridging open work permit" once CPC-S has sent you Acknowledgement of Receipt (seems to be about 2 months after the application is submitted assuming no issues with the application). This is definitely faster than Inland, isn't jeopardized if you leave Canada and gives you an open work permit. The only downside to CEC is that if you have a medical issue it is an issue (spousal are exempt from "excessive demand" medical issues).

Hi again.
So our forms are almost ready to be submitted for me to sponsor my husband. We currently live in Belgium. My last CRA filing was for 2012. Will they still give me an Option C printout? Do I actually need it? This is the last hurdle in our application.
Thanks again for this forum and info. It is very valuable! ;D

They want to ensure you are not on social assistance. Did you file an exit return with Canada?

Only if you had Canadian source income (or partial year income).

Since you filed an exit return, you can get an option C for 2012 and advise the visa office that you exited in 2013. You could also send along authorization for them to verify that information with CRA (CRA won't disclose information to CIC without written authorization).

Hello Leon,
I applied P.R for my husband on 5th june 2014. Visa office Sydney Australia.
He is on bridging visa in australia. Is it gonna effect his file?

Hello,
I applied to spouse open work permit from India and got visa till Sep 2014 ( 3 months less than my spouse's visa due to passport expiry). Now I have got my passport renewed and applying for visa extension aligned with my husband's study permit.
The problem is I am currently employed but in a different province than my husband. I visit him regularly due to employer flexibility and He will be joining me after his studies though.

My question is, in the letter of explanation, should I be mentioning these details as to why I am in different province? or explaining that I visit him often with flexible work hours? or I shouldnt mention anything and just ask for extension?
Does this situation pose a risk for my extension? How do I present this favorably to CIC?

They will know I am in different province as the present address is printed on my new passport.
Please help!!

You need to post this in the "Foreign Workers" section. This is the wrong section.
