Hi guys!

Can i have a question regarding our application. We sent our application package and it arrived at CPC-M last September 19, 2014. I just realize now, September 30, 2014 that we lacked 1 document and that is my document checklist as immigrant. Can i ask if what is the right thing to do at this moment. Should we call the CPC and inform them and mail them the lacking document or should we wait for them even if we already know that it is incomplete? This been troubling me.

They won't be able to match it up with your file until you receive a UCI number, so don't just send it. Hopefully, since it is a checklist, they won't flag it as being incomplete. If they do, chances are they will simply ask for you to send the checklist and hold your place in queue.

Yes, just wait for them to contact the sponsor. When I sent the application to sponsor my husband, I had put the general checklist, but forgot to put in the country specific checklist. They didn't hold up the sponsor approval by requesting the checklist, so hopefully it will be the same for you.

@tink23 hopefully we will land with the same situation as you do ma'am, honestly my anxiety is not yet relieved but that gave me hope, thank you so much. We will just wait till then and be ready for the lacking paper if they will be needinh it.

Dear All,

Just started preparing my application for spousal sponsorship after gathering every document under the sun. One quick question about dual nationality: is there any difference as to what nationality I apply as (I am Serbian and Bosnian) as long as I provide details of both? I was thinking of applying as a Bosnian as I was born there but I haven't lived there in a very long while and I use my Serbian passport more often. Secondly, is one set of documents (birth, marriage etc. certificates) enough or do I need to provide it from both?

As for police clearances - the instructions are quite adamant that it be only provided for places I have lived in for 6 consecutive months since I turned 18. I did not live in Bosnia for that period since I was 18. Do I still send it as it is from the country of my nationality?

My spouse PR is going to expire next year and cannot renew coz she did not meet the residency requirement. so best bet is to sponsor her bu cannot do so of she still have a valid PR card.
Any idea how to work this out?
Any suggestion will be welcome.

What if I am a TFW here in Alberta and my soon tobe wife is a PR in Vancouver..Then we applied for my PR am I eligible aswell to apply for a open work permit? Thanks in advance?
We are planning to get married on Dec.2014 then maybe apply for my PR on February or January 2015..Is it possible I can apply for open work permit though I still have a work permit until 2016? and ok lng ba yun na magkalayo kami kahit kasal? pero may mga call logs kami pictures, pics of wedding joint bank account. though also last August lang kami nagkakilala? I'm not sure about this, but if she does lose her PR because she didn't meet the residency obligation, it will be difficult for her to be approved a second time.

Some people have been able to return to Canada without any problems, even if they have not met the PR obligation, and just remained in Canada for 2 years. This will, in essence, restore her residency obligation but she should NOT leave Canada before she has 730 days of residency.

Thank you for your link. it will help me. My situation is quite different. I and my wife are Indian by nationality.I have a PR of Canada and my wife also got the PR visa in 2013. However, due to her Master's Program in USA and her internship after the program she couldn't go to Canada for her PR visa stamping. I am now planning to reside in Canada, So what would you suggest shall i meet the Visa officer and request him/her to reconsider her PR visa and reopen the file or i have to restart her process all over again for the new application.
Also i am wrapping my stuff from USA and i have to do back and forth to Canada due to my business in usa,so how many days i can live outside the Canada. Please help us out in finding the best solution.

Yes, it is possible to do so. However it requires an active decision: she must either sign a document voluntarily surrendering it (this form can only be obtained from a visa office, it is not available online), or she must be refused a PR Travel Document, or she must be given an A44(1) report at the border - with a removal order that is stayed for 30 days, or she must be investigated by CIC as part of a PR card renewal.

If her goal is to come back to Canada, she might find it easiest to return to Canada now. CBSA might permit her to enter, in which case as long as she remains in Canada long enough to be back into compliance before she applies for a new PR card, she is fine - the PR obligation is always a review of no more than the past 5 years. Alternatively, she can apply for a PR Travel Document and present H&C arguments for why she has not been able to meet the residency obligation. Ties to Canada (e.g., a spouse) and the resolution of the underlying issue (e.g., a sick parent) might be sufficient to convince the visa office to grant an H&C exception.

Depending upon your own status in Canada, you might be able to sponsor her once again - but there are potential complications. For example, suppose that she sponsored you to come to Canada and you landed 2 years ago. You are barred from sponsoring a spouse to Canada for five years from the date that you land and thus cannot sponsor her. On the other hand, if you immigrated together (or you sponsored her before) then nothing prevents you from sponsoring her again.

They will not reopen the file. She must apply again - if you are going to sponsor her, you will need to be living in Canada to do so.
