Hi,

Our situation:
I'm from The Netherlands and my fianceé is a Canadian Citizen by birth. We have been living in a common law relationship, in The Netherlands, since October 2014.
My fianceé has been un-empolyed since then, and put her time in learning the Dutch language. I have been supporting her all that time.

We now want to move to Canada, but are unsure what path we should take. If we can move to Canada will be living with her parents in Toronto for the time being.

Questions :

1) Can my fianceé sponsor me even though she lives with me in The Netherlands ?

2) Does she need to have a job first in Canada, before she can sponsor me ?

3) What forms would we need to make this happen ? ( The CIC-website is not to clear on that )

4) Do I also need to do an IELTS test ? (because the forms don't say that)
If so can I submit the forms, before I have done a IELTS exam ( I have a exam in October )

5) How long does one have to move to Canada, after receiving the go ahead from the Canadian Goverment ?


Hopefully we can get a push in the right direction.

If you´re going to live with her parents, they can sponsor you or at least be guarantors that you would not go on socail assistance. I know about a similar case, and she couldn+t sponsor him in this same situation. So her parents sponsored him. If they state that they will provide for you then it´s fine I think. So, if this is the case, she doesn´t need a job before you apply. Otherwise, yes, she will need to have some kind of income to support you in Canada.

About the forms I´m not sure but it´s definetely Outland since you are outside Canada.

You don´t need an English exam to apply.

If you cannot find more information and you cannot call CIC from the Netherlands, either her parents can call and ask or else you can call an immigration lawyer and have a consultation on the phone. They have to know about this and how to do it.

1. Yes she can sponsor you, you have to demonstrate that you have 'combined' you affairs and have been living in a C/law relationship for 1 year. Note Canadian citizens can sponsor while living abroad, but they have to demonstrate what steps they taken to re-establish themselves in Canada (housing, job, schooling etc) once you are issued a visa.
2, No, she doesn't require a job but she will have to demonstrate that she will be able to support you without welfare assistance.

4. No, you don't require an IELTs , but you will require Police Certificates for all countries where you have resided for more than 6 months since turning 18 and a medical exam.
5. Your visa, if issued, is valid for 12 months from the date of the medical.

Hi Helena, not yet, but i did upload PCC and Sched A a few hours ago so i hope to get Medical request soon. How about you?
 
Funny, I uploaded Police certificates today as well :)

Schedule A 2 weeks ago.

Then i hope we both get our medical request soon!

That would indeed be nice, but seeing that everyone has to go through it i deem it unlikely, alas.
 
What does your Application Status grid say about Medical Exam ?

Mine says "if" you need one... so I ehought maybe we get away with it :)

Yeah, not very good wording by CIC, because i dont know of anyone that got away with not doing medical, and i have a lot of threads on this forum. :)

The thing is I already did a complete one when I extended mu stay like 3 years ago, and I haven´t been back to my home country, so there shouldn´t be any need for another one :)

BUt CIC thinks in a different way... :)

Well if youre in good health you shouldnt need one, but CIC cant know that, to them a lot can happen in 3 years. Its ok i guess, a simple check up to get closer to PR is not a big deal, it does suck that i can be quite expensive, depending on where you live, here in the Netherlands its around 280 Euro.
