Hi all ...

I don't know if I am reading things correctly.

At one point I read that you could sponsor someone while residing outside of Canada - but had to indicate that you would move to Canada after receiving the visa.

But then on the Application website it states:

If I live outside Canada, may I sponsor?

If you are a Canadian citizen, you may sponsor a spouse, a common-law partner or conjugal partner, or a dependent child who has no children of his or her own. However, you must demonstrate that you will live in Canada when the sponsored person becomes a permanent resident.

Note: Permanent residents residing abroad may not sponsor from outside of Canada. Canadian citizens travelling as tourists are not considered to be residing abroad.

So what does this mean? I am a permanent resident of the UK and have my residency card. Does this mean I would have to return to Canada to sponsor someone? How long would I have to stay before I could do so?

If you are a PR of Canada, and not a citizen, you must be residing in Canada in order to sponsor your spouse. You must remain in Canada for the duration of the sponsorship application process.

Are you a Canadian citizen with a UK PR? I was a Canadian citizen with Japanese PR and I could sponsor my partner to come over (just got SA!). You just have to prove to them that you plan on coming back to Canada (I gave you some examples on how my partner and I did that on your other question).

Good luck!

Thanks!

I am a Canadian citizen, I reside in the UK and have my residency card - but I am still on a Tier 2 work visa, so I don't think I am a PR in the UK. Or I could be wrong!?

Your status in the UK doesn't really matter. As long as you are a Canadian citizen, you are allowed to sponsor your spouse from outside Canada so long as you provide proof of your intention to return to Canada once the sponsorship process is complete.

They mean permanent residents of Canada must be living in Canada to sponsor a spouse. The government does not care that you are a PR of some other country: the fact you are a Canadian citizen and not a PR of Canada is what allows you to sponsor while living outside of Canada.
