Based on the CBSA report i received, an entry is missing. I suspect this was the reason they issued me the RQ last Oct. I asked for explanation from CBSA and they said that sometimes officer at airport don't scan the documents and an entry could be absent in their systems and they cannot do anything regarding it. My questions is: should I write to CIC explaining this while I have proof of entry (stamp in the passport and boarding pass)?

Although I already sent everything while answering the RQ, would it be better to explain this separately with CBSA report reference. Will make any difference?

I don't think it is necessary, CIC knows that CBSA report are not always correct and I am partly sure that your RQ is not based on missing entry record on CBSA report. Just relax and wait for the response to the document you sent. From my experience, when I received my CBSA report there are several missing entries and I never needed to explain it.

Btw..did you also receive RQ? whats your timeline..

No I did not receive RQ, but I am sure your RQ did not include provision of CBSA report or its explanations. According to CIC officer, the records of entry and exits is not a major part of the work for them and they have a way of requesting their copy.

Dear shan,

I had the same issue so I ordered again my CBSA record but this time also sent a copy of the stamp regarding the missing entery date. I asked the ATIP department of CBSA to verify and correct my records. They did so and sent me the amended records. I will send it to CIC along with a cover letter explaning the situation. However I agree that it is not the reason we got RQ. Just let's do our best.
Good luck

I agree with applic 2013, and even if cbsa is unable to correct the record, you should write a letter mentioning the missing entry and send them the stamp photocopy in your passport.

It is always good to write a cover letter ,it makes things easy to understand for the citizenship officer.

Timeline

Applied: Aug 2013
In Process: Oct 2013
Test: Dec 2014 (Officer said she needed to do CBSA confirmation from their end)
Oath: Feb 2015

And once again about writing CIC about missing entries, if the stamp is in your passport, you dont have to worry about it. I specifically told the officer at my interview that CBSA report for me will not be accurate (I have numerous land travels). She told me that I am worrying about her job, that CBSA confirmation is one of the easiest for them. If you have sent them the pages of your passport in your RQ and every other things proving your existense and you meeting the residency then you have nothing to fret about. Forget about the process and focus on other more important things in life like relaxing :)

Just put correct dates to the best of your knowledge on residence sheet... and maybe prepare some documents for the missing dates

notalawyer,

My issue is more complicated as I traveled by bus between Detroit and Windsor and the officer did not ask me about my passport and he looked at my PR card and did not scan it. So, when I received my CBSA report that entry did not show and I don't have neither a boarding pass nor stamp on my passport and I am not sure how to proof it. I applied in July 2013 and I have not received a test invite yet.

The only proof that I have been to Canada that I accepted a job few days after I entered.

Hi Wadel

Your issue may be similar to mine, I travelled by bus, personal car, taxi etc between NY and ON on many occassions, and my passport never got stamped. I was waived in many times too . . . My CBSA report missed many travels that I listed on my residence calculation. I was a little worried but since I am sure I have more than enough physical resident days, I knew its going to be a matter of wait. Using the CBSA report, I will have more than the days that I claimed on my citizenship application so . . . At the interview, the lady looked at my passport and could only confirm a trip that I made by air. Bottom line, you may not have to prove it. I didnt.

Employment is pretty much the best evidence of residence that exists, so don't sound so down about "only" have job records as proof. Though I suspect that you do have other documentation, or could get other documentation like health records, rental records, banking records, etc.

Listen, there's nothing wrong with entering Canada by land. I personally actually landed at 2am when crossing the border on the night bus from NYC. Held up the rest of the passengers a bit, but no big deal. Don't get too worried about the limitations of the CBSA and passports stamps. You are not responsible for the border guard's decision to stamp, scan or none of the above. The CIC doesn't expect you to be. They know that it happens, they know that border records are often (or perhaps even most of the time) incomplete. Your citizenship does not hinge on such matters.

For the RQ focus on providing the best evidence that you can, don't focus on reforming the CBSA and their record keeping practices. You can't control that and it's a lot of stress for no reason.

Good luck.

Instead of reapplying for CBSA records, I would say, just send all your itineraries for which you have spent more than 24 hours outside of Canada. That should suffice the purpose unless CIC 'really really' wants to see the proof in CBSA or CBP records that you made it back to Canada.

If you can create a log of all the entries and your stamps. Then you can provide support for the missing entries. Like your credit card statement, tickets, itinerary, border fees, nexus log etc., All CIC wants to know is you came back into the country as you have mentioned in the application.
Hold on to the copies of the above docs just in case if you are ever invited for an interview.
