Hey all
I have been a pr for about 5 yrs. After spending about 10 months in Canada, i lef canada for about 3 yrs n 2 months with my canadian citizen spouse, owing to the fact that i was undergoing medical issues, pregnancy and later the wait time associated with our baby's citizenship and passport issuance. I returned canada as soon as my baby was issued a passport and have been here for past 15 months.
Now my PRC is expiring this month. All this time that was spent out of canada was never n issue as i spent all this time with my husband. I n my husband r striking a rough patch where he has left Canada and is residing abroad. Even if i ask him for the necessary documents to prove i was with him all along he would simply refuse. The house that we lived back home was my in laws. I do not have access to his passport copies or any other stuff to prove. Since there is a strong chance there would be some legal actions taken to sort out marital issues between us, i would have to travel back n forth to atted such proceedings.

I cannot apply for a new pr since the Residency obligation is not met. The previous10 months i lived in canada do not include in my total 25 months stay in canada as they r out of last 5 yr duration clause.
What r my options if i have to leave canada, how could i get back? I already have an established life here. Have a tenenacy contract in my name n all. So i plan to live on with the exception of urgent visits back home.
Can i appeal somehow for some kind of exception/relaxation regarding my situation?
 
You need to have proof that you were residing with your citizen spouse aboard if you want to apply to renew your PR card now. If you cannot obtain proof/evidence to show this, I would hold off applying to renew your PR card until you have physically lived in Canada for 730 days in the last five years. There's no exception/relaxation available. If you want to claim the time outside of Canada towards RO, you need to prove you were living with your spouse.
