But I wonder one of my acquaintance got medical request. He also applied in 2021. Guys do you have any idea how long it will take to next process after medical. But I think receiving medical request is a good sign.

Here at this point I want to ask. Now there is specific timeline from everyone based on their month and year of submission. Do we really need to stick with that time period showing or this is just the generic time period for everyone?

I really doubt that we need to stick with the time period as its showing but I wonder till last month it used to show us months like 58 or 60 months estimated time but now when we are checking our files then its increased the time to almost 3 years and that's really confusing as we all got the AOR and after that they need to verify and start processing files but how can they take that much time to process a file even they have the technology or digital tools to help them to process files yet they are asking for more time and giving no responses to applicants so its basically something else like government is may be ignoring this or may be they have no support with in their administration to process these files.

I hope some they start looking into these files as everyone have given there valuable time and money on this category with the hope of getting response and administration at least should look and response to the applicants so that they can rely on them.
 
Today I checked my application on CAS tool and earlier it used to be show " Application Received " in the status but today it showed me " IN PROCESS" so anyone have knowledge like Is there any difference or any thing which I need to concern about?

The refusal states that the visa officer does not believe I would be able to build a self-employed career in Canada. My visa office was Delhi.


Has anyone here filed a Judicial Review after a self-employed PR rejection?
If yes, what was your timeline and did it benefit you in any way?


I’m planning to proceed with a Judicial Review, so any insights or experiences would be really helpful.

Get a lawyer to file on your behalf. You need to have an explanation of the error in law so what were all the reasons for refusal? JR is not commonly used because you outline the error in law. If you "win" it goes back to an officer to review and you can be refused again. So what is your NOC because 5312 is a subset? Did you have a business plan on how you would be self employed? How much did you estimate you would make per year? You outline how you included a business plan on how you would support yourself as a self employed artist without taking on another job. State the error in law as included feasible and realistic business plan that you can implement.

Given the changes to the program with only 500 being selected every year including start up visa, your chances are low.

Sorry to hear that. I know how hard it has been. Which month in 2021 did you submit your application?

Have you been given a chance by receiving an PFL or interview before the refusal? JR's successful rate really depends case by case. You have to be able to prove that the officer made a mistake in fact or law when refusing your application for the JR to be successful. First, you have to know the reasoning behind the refusal, usually in the notes of your GCMS. apply for that and decide whether to go to a lawyer for JR. I think the time limit for JR for outside application is 60 days and the GCMS request usually takes about 30 days.

it is a long shot. But if you really think the office made a wrong decision, you can first apply for reconsideration for the same officer to reopen your case, this is tricky too. you have to prove officer made a mistake in the previous decision and it is not in everyone's nature to accept defeat easily.
