Hello,

Has anyone on here managed to renew their PR status under H&C grounds due to not meeting the residency criteria? Please help us if you have.

We currently live in the UK, our PR cards run out at the end of this year. After speaking to solicitors we've been told we have a very strong case because we were stopped from moving to Canada by the UK courts. If we have to, we will use the solicitors but they are so expensive. We want to save as much money as possible for the move itself. Surely there must be a way of doing this ourselves. The only forms online are for people that are applying from within Canada.
Please help, any information would be appreciated.

You need to be in Canada to apply to renew your PR cards.

When do you plan to relocate to Canada? Before or after your PR cards expire?

It may be difficult to comment on specific processing times since you'll be applying under H&C without meeting the residency obligation. Generally this means longer processing times and you should plan on a few months. Maybe others will comment on their specific experiences.

I believe they are generally issued for a period of six months.

Thank you for your reply, it's all so confusing.
I don't think we are going to be able to do this. It's so upsetting as we were ready to go until the courts stopped us. We will need to go back to court after we get our cards renewed, or get a travel document and the court process could take at least a year, in which time the travel document would expire.

Wait until the court process has completed before applying for the PRTD.
 
We're in a catch 22 situation.
The court won't give permission for us to relocate to Canada without the paperwork (children are involved).
If we go to court saying that we are "hoping" to get a PRTD on H&C grounds, there's no way we will be granted permission.
How many years after PR Cards have expired can we apply for a PRTD?

If this is a custody issue there is no point applying for a PRTD until you know you can relocate legally. The courts shouldn't be basing custody issues on guaranteed admission to Canada.
