Dear Brianna
I applied in 2010 with my daughter as dependent a student
She was studying but got a good job in Dec 2012. The cic was taking too much time to decide and therefore job offer could not be ignored. So we Kept her enrolled as student. We managed so that she could sit forexams.
Got medical in July 2013
Sent result of exam June 2013 inDec 13
The institute did not allow further to appear for exams and struck her off . We did not intimate to cic
Got rejected and ban of 2 years for both of us.
My q. is can she know be approved with all true documents as PA with her spouse leaving
How the overlap period of study+work is going to affect
Pl do reply . No consultant has any valid answer for it

Reading many posts of you getting annoyed “Bryanna is not a guys name”

Job offer in Canada?
Did she get a LMO at that time?
Did she then apply for a Work Permit?
Did she work?
Or did she work illegally without an approved LMO/ Work Permit?

Medical request for which visa?

Sent result of exam June 2013 inDec 13
Result of what exam?

The institute did not allow further to appear for exams and struck her off . We did not intimate to cic
The institute would have independently informed CIC about this.

When did she receive the letter from IRCC that said she was banned?
Does the letter mention a two year ban or a five year ban?

To be double sure:
The letter from IRCC clearly states a ban of 2 years, right?

The 2 years ban was changed to 5 years in fall 2014 after the amended regulations came into force

Yes it is written 2 years on the rejection letter

That's good. You and your daughter have been incredibly lucky and missed getting banned for 5 years.

To answer your question:
As the 2 years ban has passed, your daughter can apply for a spousal PR.

She must include comprehensive evidence to prove her marriage is genuine (i.e. it is not a Marriage of Convenience to return to Canada). Maybe her application could be scrutinized more closely/processing can take longer. Or maybe it won't.

Hope for the best

Both live in India and to go for the first time
The question is about the overlap period which was work as well as student
She is not claiming that study as it was dropped midway to get the job.

She cannot claim any points for Canadian work experience that was gained when she did not have any status as a worker
