This is about a family of 5 members who claimed refugee protection:
Husband is Mexican
Wife is Mexican
First child, 21 years old, born in U.S.
Second child born in Mexico
Third child born in Mexico
Child # 1 could not apply for refugee protection, being American citizen could not be included in claim and parents sent him to live with relatives in the U.S. while the rest of the family went through the refugee process; however, he was mentioned in the PIF as a dependent child.
After 4 years, family was accepted through H & C application. Lawyer made an error and did not include name of first child in the H & C application.
Family was asked to submit medical and police records. These were done for husband, wife, children # 2 and 3. Final stage of PR is in process and family is waiting to receive their PR status.
Child # 1 is in Canada under Student permit for one year in the program Hospitality Foundations.
What approach would be the best one?.....:
1. Write a letter to CIC in order to mention that the lawyer forgot to include his name in the H & C application, and ask them to include him at this stage, submitting the medicals and police records?... Would this open a can or worms and stop the process of PR for the rest of the family?
2. Let the PR process continue its course until the family receives their PR status and sponsor the child later? He will turn 22 in August of this year, the PR process might be completed after.
3. Let the child continue his program of study, apply for a work permit later, gearing to CEC category down the road?
