Hie. My name is Thandy and l hope someone can help me. My refugee claim was denied and l have a few days left for me to file an appeal. Legal aid is not assisting in the appeal as they strongly feel that it will fail again and the lawyer wants $3000. Its not easy for me to get and pay the $3000 especially when l know that the claim will be rejected. I have a permanent job that l have had for the past 2 yrs and a Chinese boyfriend. I was wondering if l can drop the refugee case completely and ask my company to help me with sponsorship or if my PR holding live in boyfriend can help. I need help urgently as my appeal deadline is a few days time. Ohh and l also have a 9yr old daughter with me...

1. If you don't appeal and don't leave Canada within the 30 days after your claim was denied, you know that your removal order turns into a deportation order and you will be removed from Canada?

You can drop the refugee case completely and ask your company to help you with PR. However you can't do that from inside of Canada. You would need to leave Canada and then apply for PR from outside of Canada. As PMM explained, if you want to stay, you need to appeal your refugee claim.

EDIT: Your post is a bit confusing regarding your boyfriend. Is he Chinese? Or a Canadian permanent resident? Or both? If he's a Canadian PR, how long have you been living together?

Who cannot appeal?
You cannot appeal the RPD decision to reject your refugee protection claim if:

  • you are a designated foreign national;
  • your refugee protection claim was withdrawn or abandoned;
  • the RPD decision says that your claim has no credible basis or is manifestly unfounded;
  • you made your claim at a land border with the United States and the claim was referred to the RPD as an exception to the Safe Third Country Agreement;
  • the Minister made an application to cease (end) your refugee protection, and the RPD decision allowed or rejected that application;
  • the Minister made an application to vacate (cancel) the decision to allow your refugee protection claim, and the RPD decision allowed or rejected that application;
  • your claim was referred to the RPD before the relevant provisions of the new system came into force in December 2012;
  • your claim for refugee protection was deemed to be rejected under Article 1F(b) of the Refugee Convention because of an order of surrender under the Extradition Act.

hello, I want to know if a refugee whose claim was denied and his asked to leave Canada if he pays for his departure and eventually leave at the given time will he be admissible again in future?

Not for a very long time.

He will be admissible. However he should assume it will not be possible to obtain any sort of temporarly visa to Canada in the future - this would include a visitor visa, study permit or work permit.

If he wants to return in the future, he would have to successfully apply to immigrate (e.g. through a program like Express Entry).
