heres a random question ... I will have my outland package done in a couple of week and then sending it off.

I will apply for my change of status to visitor in mid feb. my current work permit will expire march 14th.

do I have to include a photocopy of my current work permit even though it will expire during the process?

will I put the uk as my residential address even though I've been in canada for 2 years? my status will change during the whole process so...

also my partner and I are thinking of taking a vacation in late feb to mexico before my visa expires. will this interfere with anything? Ill be able to leave and come back because ill still have time on my visa left but will it affect my visitor application? I wouldnt be on implied status until match 14th technically so it shouldn't be a problem. was just wondering on thoughts...

For outland application there is no restriction of coming in and out of Canada , you can go apply and also go for your Mexican vacation and it will not effect each other, there is no reason to add your current work permit with your application since you are applying via London office, but you have be either a UK citizen to apply via London office or you must be legally admitted for one year to stay in UK.

For the address fill it now with the Canadian address and then when you move to UK you can submit change of address via the ECAS(the online File system )
 
I won't be moving back to the uk though. I will be staying here in canada during the whole process. 30 days before my visa expires I will apply to change my status from worker to visitor and I will remain in canada during the process.

my question is after I apply for the change, does the implied status only click in after my work permit expires while I am waiting to hear back about my visitor visa? or does it happen right away?

on march 15th I will be here on implied status for approx 80 days while they process the request during which time I know I won't be allowed to leave canada as I will be implied. but can I leave before the end of my visa so long as I return before it expires?

the implied status kicks in after you visa expires and the implied status is not 80 days but until a decision is made as the paragraph below explains and it is most likely to be around 80 days since the processing time of a vistors visa inside canada is currently 88 days on average.

Yeah sure you can leave it as you have still a valid VISA temporary resident VISA and you are not on implied status.




Implied status

A temporary resident must apply to extend their period of authorized stay before it ends. If they
have done so, their period of authorized stay as a temporary resident is extended by law until a
decision is made [R183(5)]. Such a person is considered to have implied status as a temporary
resident during that period.

If a temporary resident applies for renewal of their work or study permit and their permit expires
before a decision is made, R186(u) and R189 (the right to continue working or studying under the
same conditions pending a determination of their application for renewal) apply only as long as
the person remains in Canada.

A temporary resident with implied status who has left Canada may:

• be allowed to re-enter Canada as a temporary resident, pending a decision on the renewal of
their application to study or work in Canada, provided they are TRV exempt as per R190 or on
a multiple-entry visa. They may not resume work or study in Canada until their application for
renewal has been granted. For those not able to resume work, they must satisfy the BSO that
they have sufficient means of support. (Note that this applies to foreign nationals who are
TRV exempt as per R190(3)(f) and to those on multiple-entry visas.

• be allowed to apply for a new work or study permit at the port of entry provided they have a
right to do so under the Regulations.
 
awesome. so I should be able to apply for the extension after I send my outland pr off and then head away for a bit, come back before my work permit expires and then get implied status when it does! thanks!

also are you saying I dont have to include a copy of my current status in canada? it says I have to. which is a work permit at the moment but then that will change to visitor?

also for my residential addresa people are saying I should out my uk address even though I haven't living there for 2 years and I will also be residing in canada as a visitor during the process. should I still put the uk? this part is confusing me ...

One question, why not to apply after you come back before it expires? instead of applying the extension now?

For the implied status and visitor visa i would recommend you to call the CIC to get a confirmation their 800 number is 1-888-242‑2100


in the outland forms there is no place they are asking for your status in Canada, so there is no reason to include your Canadian status , if you are applying inland then you should include your status in Canada.

The form is asking for your current mailing address where you live and where they can sent request, notification, letters and more of your file , so it must be the place you stay whether you are on a visitor visa or not, so that the London office will be able to send you correspondence
 
the only reason I would do it before is because they want it filed 30 days in advance. so I'd have to do it on the 14th feb...

also I understand my mailing address has to be Canadian but my residential address I'm confused about...
 
when you are filling your application you will be resided in Canada so your residential address will be the same as your mailing address.
