Hi All,

I have 60 days remaining to fulfil my PR requirements of '2 out of 5 year'. I am a PR for 8 years now.
My PR card expires in Dec 2010.
1. Do you think if I go out of Canada and come back, there would be a problem on my re-entry when I can easily complete those 60 days before my PR Card expires in Dec and before I apply for a new one.
2. If somebody is found to not fulfill PR requirements on their arrival at POE. Would they be sent back/deported or allowed to come in?
3. If somebody files for an appeal, how much time there is between the filing of appeal and the hearing?
4. Say, if somebody is to have a hearing in about 6 months (for example), do they live in Canada as permanent residents while waiting for their hearing?

You may have a problem since you have been a PR for 8 years. The procedure for a POE officer is: "The most direct way a permanent resident can show that they have fulfilled their residency obligation under IRPA is to demonstrate that they were physically present in Canada for the specified minimum number of days (that is, 730 days within the previous five-year period immediately preceding examination) pursuant to A28(2)(a)(i)." So when you enter again, the officer will look at the five year period directly preceding your entry and if you do not meet the 730 day requirement, he will not allow you in. So my advice is to wait the 60 days out.
