Hi,

I want to know if the PR statue is conserved based on the landing date or the PRC expiry ?

I landed in May 2011 but I finally received my PR Card in March 2012 after some delay due to photos dimensions so my PRC expires in March 2017 .
I spent almost 3 months in Canada since my landing in 2011.
I'm planning to go back permanently to Canada by the end of this year. Is there any risk to lose the permanent residency statue or to be reported in the entry gate?

Your RO began in May 2011 when you landed. Your PR card is nothing but an official travel document that allows you to re-enter Canada. It has nothing to do with your actual PR.

As long as you have not spent more than 3 years OUTSIDE of Canada on the day you return to Canada then you will be fine. You must be able to complete 730 days living in Canada before the 5th anniversary of your official landing day in May 2011.

It sounds as if you are creeping up very close to that critial point where you will be on the verge of spending too much time outside of Canada. The only thing you can do is come back to Canada and take your chances, just like everyone else that decides to get their PR and run back to their country of origin.

If you spend or have spent more than 1095 days outside of Canada your risk of being reported at the gate increases that much more every day.

Keep in mind that once you pass the 5 year anniversary of your official landing date, you must be able to look back 5 years from any date thereof and have 730 days inside Canada to meet your RO. Anything less than that and you are in breach of your RO and risk being reported for failure to meet it if you are caught at an entry back into Canada.

Even though you do not meet the residential obligation while entering by the end of this year, you will still be a PR and you will be able to re-enter as your PR Card is valid till March 2017. But try to complete the required time once you come back.

But how the immigration officer can report me if I still have more than 2 years to the PRC expiry date ?

The PR card expiry date is irrelevant to the residency obligation requirements. If you have been outside Canada for more than 1095 days since the day that you landed, (as you landed less than 1825 days ago), you have not complied with the residency obligation, and can be reported.

Your residence obligation must have a clearly defined and legally standing reference points. It makes sense that the starting reference point is your landing date. Why should it be your PR Card expiry date? What happens if you renew your PR Card every year within the RO window because its 'lost' which extends your RO. Read the paperwork that was enclosed with your PR Card it clearly states the RO and how it works. If you can convince the FC if you are reported that the PR Card expiry date is the correct reference date then you will rock the very foundation of inadmissibility in the IRPA (excluding acquiring citizenship most PRs lose status through RO breach).
