I have gone through your posts. I want to apply for renewal of my permanent resident card in jan 2014 which expires in march 2014. I complete my 730 days in Canada , the day I plan to visit my homeland for some urgent situation and I am thinking of not returning to Canada for another 6 mths. Can I apply and catch the flight same day. Will that effect my renewal process. And also please help with calculation of days as the renewal form asks you to write number of days absent from Canada. For e.g if I left on 10/10/2013 and came back on 10/17/2013. What is to be written in the form absent from 10/10/2013 to 10/16/2013 because basically I was absent till 10/16/2013. I have used the residency calculator for citizenship for calculating my days and what if I have two or three days miscounted!! >:( >:( somebody please help!

The residency calculator for citizenship doesn't work for PR because for PR, any part of a day spent in Canada counts as a day spent in Canada. Therefore, if you left Canada on the 10th and come back on the 17th, you would still write those days for the trip but you would write 6 days absent because for PR requirements, you were only absent on the 11th, 12th, 13th, 14th, 15th and 16th so that is 6 days. For citizenship requirements, they count the nights so the same absence would be 7 days and not 6.

Thank you so much Leon. All of your posts are very helpful. So can I just post my renewal form the day I leave the country which is the same day I complete my 730 days or should I postpone my visit by 3 or 4 days. Will that affect my renewal process having 734 days or just 730 days. Do they check that I left the country the same day?? Also I have read somewhere that they don't count the day you leave the country but count the day you arrive. Is that for citizenship??Thank you so much you have solved a big problem for me.

I am so sorry to be impulsive but one last question..in the form what is to be written in the period assessment...is it till the date I am signing the application form or my 5 year period as a whole.
Thank you again for your help Leon!!

I think having more days is better in case they think you made a miscalculation somewhere. Like I said, for PR, any part of a day spent in Canada counts as a day spent in Canada. Therefore, when you travel, the day you left and the day you come back both count as days spent in Canada.

However, also keep in mind that a renewed PR card is not always mailed to you. If immigration requests that you come in person to pick it up, you will have to do that. If they figure out that you have left Canada, they will most certainly request that you pick it up in person. If they do that and you are outside Canada with an expired PR card, you might have to apply for a PR travel document in order to return.

nau,

1. You fill out details of 5 years prior the application date if you landed 5 or more years ago.
2. You fill details of period back to your landing date if you landed less than 5 years ago.
3. You can technically leave on day 730 as it counts as a day present in Canada.
4. If you go with 4 then depending on if you have been landed for more or less than 5 years it may be an issue.

If you landed more than 5 years ago and there are any issues with your application and its returned you must return to Canada to get the days count back to 730. Another issue is if you are required to pick the card up in person. If you need a Travel Document you will be in breach of the Residence Obligation and you could lose PR status if you have no H&C reasons for breach and the TD is refused by the visa post.

You need to provide your landing date for anyone to detail the risk you are taking. Can you prove your 730 days? Were you working in Canada? Have you filed taxes?
