PR + OWP Hiccup

Hello Everyone,

My wife is currently processing her PR application. With that in mind she would currently have implied status. She also applied for an open work permit prior to her work permit expiring. However, we had a hiccup with the OWP application where we forgot to sign one of the signatures and it was sent back to us within 30 days of the work permit expiring. If we apply for a new OWP would my wife still be able to work now that her original work permit has expired.

No - she has lost implied status and must stop working. She needs to apply to restore her status to be able to remain legally in Canada.

If she is out of status she cannot work. She is also not eligible to apply for the OWP if she is out of status (would need to restore her status first).

I have a follow up question. Since her work permit has expired but the PR application is still in process; what would make the most sense in order for her to apply for open work permit. Should she
A) Apply for visitor Visa from within Canada - if she did this and then applied for OWP; would she be able to work?
B) Apply to Extend her current work Permit. (She is currently within 90 days of original work permit expiration).
C) Apply for a new work permit (since the processing time seems to be quicker).
D) Apply to restore status and re-apply for OWP.

We would be doing all of these from within Canada since we're married and currently PR application is in process.

We would be doing all of these from within Canada since we're married and currently PR application is in process.

She cannot apply for visitor....change apply to restore status as visitor
She cannot apply to extend her work permit as it is already expired. She can apply to restore (provided she meets requirements) within the 90 days
She can apply to restore status and OWP. Application to restore status can take more than 60. There a some in this forum who submitted both in one package.
May be others can advice you better on this
