1. If you appeal the sec 44 report you can ask CIC to continue to process your PR Card renewal that lead to the refusal (although I'd expect this to be automatic) and a one year validity PR Card will be issued. You will get one year cards until the case is decided but most applicants on appeal usually get just one card or at max 2 cards given the time it takes to go through the judicial system. CIC will ask out of country PR Card applicants to pick the card up in person so unless you enter via the US land border you may not even get the one year validity card. 2. You can't re-apply for PR if you are on appeal. You must relinquish PR first then re-apply.
3. So it depends on you and your travel plans. If you want to save time, hassle and not needlessly block the courts time with an appeal that looks destined to be disposed off in favor of CIC then let CIC know in writing you have no more H&C grounds, waive all appeal rights and relinquish PR.
4. If you don't appeal after 30 days from when the sec 44 report was issued then PR loss is immediate. The most important thing is (if in Canada) to leave Canada before the 30 days if you don't intend to appeal. Make sure you report to CBSA at the departure airport to show them you are departing Canada. In this way the departure order issued with the sec 44 report doesn't become a deportation order.
5. To review the sponsorship process go to the CIC website and check out the Family Class sponsorship and requirements. Your Canadian spouse has to show proof of her intention to return to Canada as part of the process...best way is to have a job to come back to.
