I have a quick question and hoping someone can provide an answer:

A friend have a IN-LAND PR application pending 1st Stage (spouse sponsor), her present status in Canada is visitor till September 2015. There is an emergency back home and she need to go home for her mother's burial. How can she go about this? What is her chances of being re-admitted back into Canada if she leaves for her mother's burial? What option is available to her from CIC if she has to go for this burial? Worth mentioning that she is a British.

She should be ok, as she is visa-exempt. When returning back to Canada just ensure she has proof of PR app already in progress.

The big risk is if she were denied entry the inland app would be cancelled and have to start fresh with an outland app. But chance of rejection is incredibly small.

And actually, she should have applied outland anyways from the beginning for quicker processing and should even considering cancelling her inland app voluntarily and re-submitting outland, if she has just recently submitted it.
 
Thanks Rob for your response. Her application was submitted in March 2014 and was done same time with her refugee claimant husband PR as well hence the IN-LAND application. They're both married in Canada

So this isn't a spousal sponsorship application. It's a refugee application.
 
Only the husband is a refugee and they only got married after his Refugee claim was successful and he now included her in his PR application

If he already landed as a PR from refugee application, and is now sponsoring his wife for PR separately, then that is a family class application.

If his refugee application is still processing, and the wife was added to that refugee application as spouse, that is NOT a family class app it is a refugee app.

I'm not certain how refugee apps work exactly, but I believe it's only the main applicant that must be residing in Canada. Any spouses/dependents as part of the application could be anywhere in the world so it should be fine for her to visit back home.

His refugee application is successful and he's granted a Protected Person status already. He put in his PR application shortly after his marriage by so doing he included her on his PR application submitted together indicating that the wife is in Canada as a visitor. So I want to know how that affect my lady friend and her chances of being able to come back to Canada after the burial of her mother she wants to go for.
