They are no longer interested in accompanying me to Canada since I am no longer with their dad. They have decided to stay back home. My question is how to explain to immigration. They will not do the medical either. pls help!!!!!!
I am an august applicant, haven't received the MR yet

How old are they?

When my partner did PNP his ex-wife would not allow their daughter to do a medical. They say to include them even if they are not coming to Canada just in case in the future you want to sponsor them or some crap like that. My partners imm lawyer kept pushing for her to get a medical done. Eventually his ex-wife had to submit a statutory declaration stating that the daughter would not be going to canada and that she would not permit her to get medicals done.

So I'm not 100% sure on how to tell them but you might need a stat declaration from your ex or the kids regarding this.

Thanks for responding. I am in Canada and their is no way to get this stat. declaration for them to sign. I applied with no lawyer. They are 18yrs and 17yrs old. still don't know how to handle this mess :mad: :mad: :mad:

My partner was in Canada too and had to get his ex wife in Aus to fax a stat dec over. Just email them a sample thing of what they should say, that they are not accompanying you and they refuse a medical, and then they can write it out and take it to a justice of the peace or public notary to be witnessed, then get them to scan and email or fax it over.

it is still hard to get this done cos in my country, things are quite hard to get done and my kids family wont give them any chance to do this. just don't know what to do. did ur partner applied with his dependant and later changed his mind?

No they just wanted medicals for her 'just in case' so I don't know the best way to remove them from an application. I'd just email them. Seniors may know better. You probably will need some sort of statement from your kids though. Maybe.

Why don't you try it at least?

Just to eliminate the possibility that the kids are being coerced, you may want to explain it to the kids and significance of doing the medicals whether or not they will follow you to Canada. Also explain what it means if they do not undergo the medical exam. Quote the wording about it from CIC's website(and provide URL link in case they want to confirm).

After that you can may be write a document like the one below (just an example):

I, [name of 17 year], born on [date of birth] to parents, [full name of mother] and [full name of father] on this __19th__ day of July 2013 confirm that the above information and possible implications have been explained to me by [name and relationship or name and occupation of person explaining]. I confirm that I have read and understood the information above and my questions have been answered to my satisfaction. I therefore decline to undergo a Canadian Immigration medical Exam and I understand that in doing so, I can not be sponsored by my mother as a member of the family class at any point in the future. I confirm that this decision was made of my own free will and I was not coerced.

That's a good question! If you were to inform them now, it would be without the signed document/statutory declaration, right? In that case, do you include a cover letter saying you are working on it?

Just going by CIC's recommendation to notify them immediately of a change in status(though this isn't really the same), perhaps that's the way to go?

Or may be(if you want to) wait until you have the signed document/statutory declaration to notify? Who knows, medical requests may come through by then.

Hard to know the right answer...this one is your call. Sorry. :) Just my thoughts though, perhaps others can comment.

Better to say in a country in Africa or in an African country, etc. Some people actually believe this stuff and I've spent considerable time pointing out Africa is a continent. :-X
