Hello,

I recently received an ITA on April 14, 2026. I have several complicated cases, but I will just post one for now. I need your advice. Note: I am currently pregnant with EDD May 26, 2026.

My husband and I previously held valid work permits, which expired Jan 2026. After which, we left Canada. While being pregnant, we are discussing our steps moving forward. So we mutually decided that I will pursue my CEC as the principal applicant, but my spouse as non-accompanying this time. I have declared my husband on all of my IRCC app, inculding this CEC app. Additonally, I have an LOE with my commitment to update IRCC on my future dependent after I give birth. Both my husband and newborn child will not come with me in Canada. We have our full family support in our home country, and the baby needs continous postnatal care to monitor growth & development. Travelling internationally and relocating to a new place for a newborn child is not feasible and not safe. Also, I wouldn’t know how my birthing will exactly happen (though I am praying all will be safe and goes well). Now here’s the most important part. I included on my LOE that this decision is just temporary and we are still considering our reunification plans. I just want to be honest with my intentions. Once I am settled, my child’s medical situations are cleared, and given all immigration laws & regulations are complied, I will sponsor them to join me in Canada.

Question: Due to personal and medical reasons, I have declared my husband and baby as non-accompanying. Do you think that will be acceptable on the IRCC’s pov? Also, declaring honestly that I still plan to sponsor them in the future?
 
Not really complicated at all. They are non accompanying and not in Canada. You will move to Canada as PR, apply to sponsor them and stay in Canada until processed.

Right. Thank you. My only concern is since my husband has Canadian Work Experience, they might ask why not include him. But just like I said, it’s for personal and more of my child’s medical reason. Thanks again!

If he is not in Canada and not using points for his work experience then should be fine.

The only caveat I would probably add is he has ever applied for PR himself or attempted to extend a WP then that could be an issue. The whole family will have to pass medicals so if newborn is expected to have such serious health issues that makes relocating impossible then that may be a concern for excessive demand. The argument of why baby can’t accompany mom (and dad) to Canada may backfire. If your due date is this month not sure how delivery has any impact on your application since you would be delivering in your home country.
