correct not sure about the legal side of being common law but we are couple and been living together since oct 2019, she got PR last oct
So why were you not included in her PR application if you have been common law since 2019? She would have included you as a spouse since she has had time during the whole process, and only received PR in 2021. If so she can’t sponsor you because she misrepresented herself as single. You need to qualify on your own.

i guess we didnt know about this whole common law thing...... my application is still in the pool. should i include her now?

No. She is already a PR and can't be included as a dependent in your application.

to be more precise on the situation, at the filling of our PR application, we did not have anything to prove that we are together. Prior to Feb 2021, we were living in together but every document (lease, bills, internet...) were under my name. It is after Feb 2021 we started to "officially" co exist (having the lease on both of our names, insurance, bank accounts...etc). We filed our application on Apr 2021. Will this make any sort of breakthough?

This doesn't change anything in terms of her being able to sponsor you. It's still not going to be possible. You address history will show that you've been living together for well over a year and she failed to declare you as her common law partner before becoming a PR. You have to qualify on your own. She can't sponsor you.

One can argue that we were just roomates, nothing serious. I think i should seek for professional help, if i need to go though this path

You can try anything. If you want to seek professional advice, go with an immigration lawyer. Stay away from immigration consultants.
