Hello, I've got a question, Ive lived In Canada for 760 days ( between 2008-2013) after Ive applied for a renewal of my PRC and couldn't wait for it and had to leave Canada for some family issues and took my young sister with me to mu MOM, however my DAD stayed in Canada ( he is a citizen) , and I've stayed in my home Country till today. Ive got my papers of renewal back to the place in Canada where I used to leave and if I'm not mistaken there was some issues with T4 paper that's why all my documents came back and I did not applied again since I was not able to go back to Canada. So now, when I decide to apply for a renewal I was told that I need to be in Canada in order to apply for renewal and in order to get to Canada I need to apply for Travel Document which I did and got rejected and after I got an option to apply for residency obligation appeal in order not to loose the Status of PR. Now im waiting for a hearing date, where I will be on the phone with them. So how do you think , will I be able to win the case? Since I did not have any criminal record, any problems such as that in Canada, was working and studying ....
 
Whether or not you can win the case depends on what evidence you provided to demonstrate why you weren't able to meet the residency obligation. Did you include proof in your appeal to show why you were unable to return to Canada to meet the residency obligation (i.e. proof of what kept you out of Canada)? For example, if you were taking care of an ill relative or had an illness yourself that lasted several years and made you unable to travel - then you should have provided hospitalization records and doctors notes to support your claims.

Attending school or working outside of Canada won't be accepted as valid reasons for failing to meet the residency requirement. If you were outside of Canada because you were working and studying, you should expect your appeal to be refused.
 
Thank you Scylla for your reply, yes, I was taking care of my Mom, also I came back because my Grandma and Uncle died into an accident, so I had to be near to my Mom because she had none around, now I got my cousin who came back from turkey and will stay with her so I can go back To Canada, but i did not send any records of that to appeal, however, I was told that I can present all of this proofs at the hearing, ( which i can do through my Dad)
 
In that case make sure you collect as much evidence as you can and provide it to your father ahead of the hearing. Good luck.
