Hello folks,

My parents submitted their visitor visa application 4 months back. My mom's visa was approved in 2-3 weeks but there has been no update on my dad's visa application.

I received the gcms for my dad's application today and the last updated date is the date of submission of application. There has been no update in last 4 months.

Can someone please help or guide as to what can be done in this regard? Thanks

Would call IRCC so they can flag it for processing. If still no movement then would speak to your MP.

My parents submitted their visitor visa applications on April 20, 2024, through the portal, to attend my convocation and spend time with me in Canada.
Timeline of Updates

  1. April 30, 2024 – First update on both applications: Biometric information was updated.
  2. May 24, 2024 – Second update (father’s application only): IRCC requested a detailed explanation and documents regarding my father’s service history as an ASI with the Punjab Police. This was promptly provided.
Since that date, there have been no further updates or progress on either application.

In terms of assessments for both:

Eligibility – passed

Criminality – passed

Security – in progress.

All the assessments were passed, except for the security, which is conducted by a third party and not by an IRCC officer.

This means that the IRCC officer in charge of the case has inquired with the security services of the applicant's country of origin, as well as any countries where the applicant has stayed for more than six months.

The delay in processing the application may be related to their response. Therefore, it’s beyond the control of the IRCC and cannot be affected by anyone, including the MP office.

Unfortunately, based on my experience with similar cases, it's just a matter of time, and there's nothing the MP office can do to expedite the process.


Can anyone please help me? What can I do next?

At a certain point you can file a writ of mandamus but that may be more at the 2 year mark. Speak to a lawyer.

’m in a similar situation. I submitted Super Visa applications for both of my parents in April 2023. My mom received her visa within three weeks, but my dad’s application has been stuck in background check ever since. He previously served in the military.

I’ve followed up several times with my local MP and also requested GCMS notes, but haven’t had any progress. I’m now considering filing a writ of mandamus, but I also have a PGP application (June 2024) submitted for both parents that’s facing the same background check delay.

I’m wondering — would proceeding with the writ of mandamus have any impact on the PGP application?

Unless you have the extra savings to pay for lawyers I would probably wait and apply for writ of mandamus during the PGP process if it becomes necessary vs for a TRV. That said filing for writ of mandamus for TRV won’t impact PGP.
 
My parents' visas have been stuck for 2.5 years now. I filed for writ of Mandamus back in April. The application has been sitting with the court since July and there is no timeline on when it's going to be seen by the judge.
And this is only for the judge to decide whether we have a case that should go to hearing. If the judge grants the hearing, it might take 1+ years of wait time for that as well.

Unfortunately, Mandamus is not helping either.

Yes courts are very overwhelmed and will only get worse sadly.
