Hi all,

I am a Canadian PR, and my partner is currently applying for a PR through the Hong Kong Stream A/B Permanent Residence Pathway, to which she has applied since early January 2024, and is still waiting for her AOR.

We have been living together continuously since November 2022, and when she was completing her application in January 2024, she put "single" as her relationship status, believing that it wouldn't matter that much since I am already a PR, and putting her status as "in a common-law partnership" would not help her application. Now we are increasingly worried about the possibility of misrepresentation, and might eventually lead to refusal of her application.

Would like to find more information about this situation as we understand that this is a very unique situation and not much info about this can be found online. If there are grounds for this to be considered misrepresentation, is there any solution to this issue?

Just to be clear, she is NOT applying through the spousal sponsorship program, but instead the Hong Kong Stream A/B Permanent Residence Pathway.

She should have indicated she was common law. Have her submit a webform to correct this error and indicate that the common law partner is already Canadian.

When did you receive your PR?
Since there is a huge delay on HK pathway (H&C), if you became common law partner with her after your became PR (eCOPR or COPR landing), you can consider applying to sponsor her instead.

I received my PR in 2021. Our concern is I just recently finished graduate school and do not have a sizeable nor stable income to sponsor her. On the other hand, she has been working full-time the past 2.5 years and have quite stable income. Would that help?

She should correct her status now to avoid delays or issues later.

There are no income requirements to sponsor a common law partner or spouse. You sponsoring her will be way faster.

I'd seriously suggest you sponsor your spouse now. In fact it's what you should have done then.

No formal requirements for spousal sponsorship, if you are going to school on your own steam and your spouse is working, should be fine from spousal sponsorship point of view. (Yes, they do take into account the spouse's employment / history).

Update her application via webform as soon as she can. Include a letter of explanation and make sure her application is MARK for HK Pathway.

Start to gather information to sponsor her. lease agreement with both of yours and her name, utility bills, provincial documents, employer form to show that you are her common law partner (e.g. for extended health insurance, life insurance ...etc)
Apply to sponsor her. (if she plans to travel, apply outland otherwise, inland) Both routes will allow to apply for OWP once your sponsorship application has reach AOR.
There is no specific income level to sponsor her. IRCC just needs to know that you won't go into social assistance. So your job potential (graduated and looking for work) and that she has been working and any savings would show that you two can managed to live without social assistance.
