Hi, Friends,

I applied my PR card to renew in 2014, but got a removal order from CIC, then I appealed to IAD in March 6,2015, I received a one year PR card, till now there is no any information about my hearing, and I had been in Canada for over 2 years.

My question is: May I apply to renew my PR card now? or have to wait IAD decision, the temporary PR card will expire very soon, what can I do if I need leave Canada?

Many thanks,

If you attempt to renew the card, they may grant you another 1 year card. You have a right to a status document, if you have the status.

As for leaving Canada, it might not be the best idea. Have you tried calling them to find out if anything happened with your case?

Like kateg said, you can apply to renew the one year card for another one year card. The two years you have spent in Canada on an appeal do not count towards the residency obligation unless you win your appeal.

Thanks a lot for your kind reply.

But I visited the CIC website, the eligibility to renew the PR card is : have not been asked to leave Canada buy the government, is that correct? the removal order is something like this?

Also I called IAD, they told me the hearing may take another one or two years.

Many thanks again!

In ENF 27 on page 27 it says:

54.(2) A permanent resident card is valid for one year from the date of issue if, at the time of issue, the permanent resident

(a) is subject to the process set out in paragraph 46(1)(b) of the Act;

(b) is the subject of a report prepared under subsection 44(1) of the Act;

(c) is subject to a removal order made by the Minister under subsection 44(2) of the Act and the period for filing an appeal from the decision has not expired or, if an appeal is filed, there has been no final determination of the appeal; or

(d) is the subject of a report referred to the Immigration Division under subsection 44(2) of the Act and the period for filing an appeal from the decision of the Immigration Division has not expired or, if an appeal is filed, there has been no final determination of the appeal.

So I guess you fall under (c) and hence you are eligible for a one year card as long as your appeal in still being processed.

You can find ENF 27 and other immigration manuals here: http://www.cic.gc.ca/english/resources/manuals/
