This has been on the news lately. What are your thoughts? Although it seems cruel to deport an old lady, my feelings are that by allowing an aunt to stay they are setting a precedent. At first I felt sympathetic, because the Canadian citizen said the aunt raised him like a mother.. she appeared so old and frail on the news, saying she would rather die then returning to India.. and the son said she would probably just die on the road and that she would have nobody in India.

But he already sponsored his real mother into Canada.. what are your thoughts?

I feel sorry for them, I really do. But law is law and if they let her stay someone else will use this to advance their case and it will become a snow ball effect. But unfortunately this is what happens when people emigrate. They want to bring their whole family with them even if by law they can't. I hope they can figure out something though so she will be ok. Because it looks like she's going back to India.

Agreed. If H&C grounds are "so evident" then why wasn't one of their H&C applications approved? And if none were such an application, then they should submit one . . .

I really feel sorry for them too. They're really pulling on the heart strings saying that she will die alone on the street. But it seems to me it was the son's intent to try and bend the rules to sponsor her after she got a visitor's visa all along. I don't like it when people try to play the system, but still I really feel for the old lady, she's in a terrible position.

Even if she is deported back to India, there is no reason for her to die alone on the streets. If the family loves her that much, then I would hope they would arrange for a place for her to stay, pay her living expenses, and hire someone to help care for her - all of which would be much cheaper to do in India than in Canada.

She'd still die alone in a country with none of her family. They're all living in Canada now, and sure you can hire someone to take care of her, which it absolutely sounds like the family would, but is that really the same as being with the family, including the children you basically raised?

No, it isn't.

Frankly, in a forum full of people who in many cases have been separated from their loved ones for an extended period of time, I wouldn't have expected any negative replied to this woman's plight. I don't know why their H&C applications have been denied, but it certainly doesn't sound like they should have been.

I think it is a good example of somebody who should be able to get a TRP. TRP's are given on a case by case basis. If immigration had allowed her to stay, the case would never have become public and they wouldn't have to worry about a landslide but even if it is public now, I still don't think it would cause a landslide because I don't think that many people have 83 year old aunts who raised them.

I just wish that my loved one could have also got a visitor's visa. My heart really goes out to her, and ideally she should stay with her loved ones. But can't we all have our loved ones? It's just the fact that she came over on a visitor's visa with obviously no family or anything left in India that makes me wonder how this happened - I'm curious how she got a visitor's visa with no ties. I'm not trying to be heartless.. I thought it would be an interesting case to raise for discussion.
