I am an inland applicant. My application was returned last Friday because I didn't include a photo and birth certificate of my non-accompanying child. The problem is that my child lives with the mother in the US, and she has refused to send me his passport-size photo. If she cannot allow her to take a photo, I doubt she will allow her to do a medical exam. Please, what options do I have to deal with this issue?

You actually still have a few possible paths, depending on what you can prove.
Option 1 — Re-submit with explanation + proof of refusal
If you truly cannot get the photo or later medical, you can usually:
Submit a Letter of Explanation
- Show proof you tried (texts, emails, legal letters, custody orders, etc.)
- Provide custody documents if you have them
IRCC expects you to support any claim with evidence, not just statements.
Option 2 — Non-accompanying parent declaration / custody proof
For minors, IRCC often wants:
Consent form from other parent (IMM 5604), OR
- Court order / custody proof, OR
- Explanation if you cannot get those
If you cannot provide consent or equivalent, you must explain in detail why.
Option 3 — If child cannot complete medical (very serious consequence)
Important reality:
Even non-accompanying dependents are often expected to do medical exams. If they don’t, IRCC may:
Refuse the application, OR
- Allow processing but permanently bar you from sponsoring that child later (case-by-case, often needs strong proof you tried).
(Practice reality based on immigration process + case discussions — officers look for proof you made real efforts.)
Option 4 — Legal / court route (if mother is fully blocking)
If the mother is fully refusing:
Family court order in US (if you have rights)
- Lawyer letter requesting cooperation
- Written proof of refusal
- This becomes important evidence if you claim “I tried everything.
