Hi All Experts and seniors,

I need a quick advise on the next step i should take, i got me and my wife med in feb more precise 6 feb and before that we blessed with baby imy consultant raised cse and we completed initial formalities of baby addition and got baby medical done upfront along with ours on 28 feb and sent the docs on 18 march. But till now no 3rd line update. I checked with max delhi as per them medicals were all fine and uploded by them on 5th March. What could possibly be the reason for this delay in 3rd line update its been 122 days since we completed our medicals. My rprf fees dd was encashed on 26 march.

Hi all , we have applied for the spouse permanent visa on March this year , we have got the sponsorship approval and file have been sent to Delhi for further processing , now my wife is planning to visit me for about 3 months and she will quit her job as they will not give so long vacations ,she is currently Permanent resident of Canada . I have questions that will it effect our case , as some says that sponsor have to stay in Canada while file is in process. If I am not wrong it just at the time of lodgement PR applicant has to to physically present in Canada . Plz advise or help would be very thankful.

I just replied earlier:

As you know a PR holder is required to be in the country while the application is in progress but its understood that we can take a short holiday for 2-3 weeks and anything over will only cause a trigger that the sponsor has abandoned and has moved outside the country thus making the application invalid.

I would say a month max and nothing more.. So three months is definitely a big no according to me..

I am confused, you got married when you came to India on May 2015 does that mean you haven't submitted your application yet since you are still in India?

There isnt a link on the site but a PR cannot be outside the country while sponsoring anyway

It is generally understood and accepted that a short visit is ok - I called CIC to confirm and was told there is a set amount of days for a PR can be away be a short visit is ok and thing longer is considered abandonment since the PR has to be in the country.

Hi bro do not do this kind of mistake. If a Canada PR holder has applied for someone sponsorship file is not allowed to leave Canada more than 2 weeks up to the time complete file processing time. There will be problem for your application.
if your wife has citizenship then there will not be any problem.

Hey you have to be in Canada to apply for your spouse and you have to wait till the file is transferred to Delhi (advised by a lawyer). I myself went and lived in India for like 4 months with no issues at all and I have seen many who have done that as well I don't see it being a problem it might be a bigger problem if she doesn't visit at all because in case you do get interviewed (which I really hope doesn't happen) one common question is how come your spouse never visited you but I would consult with a professional to be on the safe side :)

The guide says a PR must live in Canada in order to sponsor. There are no defined rules for how much time is allowed out of the country, or even if the PR sponsor has to physically be in the country. However, you really don't want to play with fire here. Why take risks that could jeopardize the application?

If I were your wife, I would not leave the country for even one day. I certainly wouldn't quit my job first. How's that going to look to the CIC? "Quit her job and moved to India to be with her husband. Application rejected."

It may work and I'm sure lots of people have done it, but why chance it?
