I have a child back home and he's almost 3 months old, her mother (my girlfriend) and I have a long distance relationship and we didn't live together at all! I got her pregnant the last time I took a vacation last Dec. 2011. My question is do I have to include my child in my PR application?

pointing on this subject..

1. Did your family composition change since our last correspondence?

· Have you married or divorced?
· Have you given birth or adopted a child?
· Do you intend to get married or divorced prior to becoming a permanent resident?
· Do you intend to give birth or adopt a child prior to becoming a permanent resident?

If any of these conditions apply, your new spouse and/or children must be added to your application and be found admissible to Canada before permanent resident visas can be issued. Failure to declare additional dependants such as a spouse or children before you become a permanent resident could result in the cancellation of your permanent resident visa. Once your file is closed, you would be required to submit a new application and pay new processing fees. Any new application would be assessed under the Act and Regulations in force at the time of its submission.

In the event that you do have additional dependants to add to or remove from your application, you should immediately advise the Case Processing Pilot – Ottawa (“CPP-O”). You will be asked to submit evidence such as a copy of the marriage, divorce, birth or adoption certificate or a letter advising when and where the marriage, divorce, birth or adoption is expected to take place. Do not undertake any other steps until CPP-O indicates that you can proceed with the rest of these instructions.

Yes - you must include the child in your application.

2) You will be committing misrepresentation by saying you have no dependent (when in fact you do). If the misrepresentation is caught before your PR application is approved, you will be given a two year ban from Canada. If the misrepresentation is caught after you become a PR, CIC may revoke your PR status.

Again - you have no choice. You must include the child.

Hey Toink, I see you got your passport request today...
it is too late to declare that child now. for my point of view I will ask you to finish your PR process. once you are PR go home marry the girland sponsor your family (family class sponsorship) it wont be a problem for the kid

and also I think you have only one month to submit your passport(?) if you add your kid now, it will be pretty messy since Detroit is already waiting your passport. it is still fine to marry the girl later and then do the familly class sponsorship as I think

yes I only got 30 days to submit my passport, but I am really confused now, specially when i read that letter from CIC, I didn't declare my child before because i dont know what to do, I dont have any consultant or a lawyer.

it will only affect the child in future when ur ready to sponsor her.. u should have notified cic when u gave birth 3 months ago and include her in ur application.. i guess the best thing to do is to still notify cic. u can send email with child birthcertificate or call and see what they will say.. u dont have to keep quiet in a situation like this otherwise it will come to hunt u in the future.. congrats on ur ppr..and all the best

This is incorrect. If the child is not declared now, it can NEVER be done. If the OP lands and this hasn't be done, he is guilty of misrepresentation, and can even get his PR revoked. If you care about your life and your child, do this ASAP, no matter how long the processing takes!

You said it yourself what you need to do:

If some of the stories on the forum are any indication, there is the potential for another issue(depending on the intepretation of the visa officer assessing your file) - you had a girlfriend as of Dec 2011(whom you have a baby with). A visa officer may be of the view that she should have been in part of your application from the start especially as having a kid may demonstrate long term plans.

A guy in the "skilled worker" section was refused landing and sent back to his home country because he revealed that he had a fiancee. The border agent was of the view that she should have been in his application from the start.

You may want to speak to an immigration lawyer first before you make a decision but the child must be declared - no choice.

Just sent all my childs requirements, birth certificate, photos and IMM 0008 generic form (like the immigration officer told me to send). and its been a week since CPP-O recieved it and until now I dont have response from them, does any of you experienced this? and do I have to send the 150$ processing fee for my child right now? or wait for their instructions?
